As used in this article, the following terms
shall have the meanings indicated:
SWIMMING POOL
Any outdoor receptacle, structure, tank or excavation constructed
for the purpose of holding water, which retains water at any point
to a depth of at least 18 inches and is more than 30 inches in width
at any point. The term "swimming pool" shall also include adjacent
decks, diving boards, slides, equipment, machinery and other appurtenances.

A swimming pool shall be permitted only in a
residential district and only as an accessory use to a principal dwelling
located on the same lot or premises.
All swimming pools shall be maintained and operated
in accordance with the provisions of this Article and all other applicable
laws, rules and regulations of the Village of Thomaston, the Town
of North Hempstead, the County of Nassau and the State of New York
and any agency, board or department of any such governmental authority
with jurisdiction over swimming pools. In addition, all swimming pools
shall be operated and maintained in accordance with recommendations
of the Nassau County Department of Health with respect to the care
and maintenance of small swimming pools.
The area adjacent to the fence surrounding every
swimming pool shall be screened by plantings in accordance with a
landscape plan submitted to and approved by the Board of Trustees
at the time of permit approval as provided in this Article.
Any person, firm, association, corporation or
other entity which does any act in violation of this Article shall
be guilty of a violation.
