The Building Official or his designated representative shall have the power to institute any proceedings at law, in equity, or authorized by Chapter 220, Zoning, necessary for the enforcement of this chapter.
A. 
The Building Official shall serve a written notice of violation on any person in violation of this chapter, which violations would include but not be limited to:
(1) 
Failure to apply for a certificate of appropriateness or a building permit required for the erection, reconstruction, alteration, restoration, demolition, demolition by neglect (those activities set forth in Article VIII, § 130-28), or razing of any building or structure which can be seen from a public way;
(2) 
Failure to comply with the conditions specified by HARB and/or Borough Council on the certificate of appropriateness or that are associated with any preapproved activity as designated herein or subsequently adopted by Council upon recommendation by the HARB.
B. 
The notice shall direct the abatement of the violation. Appeals of any such notices shall be taken before the Zoning Hearing Board of the Borough of Columbia and shall be conducted in the manner set forth in Chapter 220, Zoning. Moreover, pursuant to Section 5 of the Act of June 13, 1961. Public Law 282, No. 167,[1] as amended, the agency charged by law or by local ordinance with the issuance of permits for the erection, demolition or alteration of buildings within the historic district shall have power to institute any proceedings, at law or in equity, necessary for the enforcement of this act or of any ordinance adopted pursuant thereto, in the same manner as in its enforcement of other building, zoning or planning legislation or regulations.

The penalty provisions of Chapter 220, Zoning, are incorporated herein by reference and adopted as the penalty provisions hereof.
The provisions of this chapter may be amended in the future by the Borough Council upon recommendation from HARB, after notice and a hearing as may be provided by law.
A. 
Immediately upon the adoption of this chapter, the Borough Secretary/Treasurer shall forward a copy hereof to the Pennsylvania Historical and Museum Commission.
B. 
This chapter shall take effect immediately upon the occurrence of all of the following:
(1) 
Adoption hereof;
(2) 
The Pennsylvania Historical and Museum Commission has certified, by resolution, to the historical significance of the historic district;
(3) 
This chapter and the said Commission's resolution have been duly advertised as required by applicable laws; and
(4) 
The appointment of the membership of the HARB by the Council of the Borough of Columbia under § 130-10 of this chapter.
