The Chesapeake Bay Preservation Area Regulations
shall apply to all unincorporated areas of Northumberland County,
Virginia, identified as Chesapeake Bay Preservation Areas as designated
by the governing body and as shown on the Northumberland County Chesapeake
Bay Preservation Area (CBPA) Map. The CBPA Map is hereby adopted by
reference and declared to be a part of this chapter.
The Resource Protection Area (RPA) includes:
B. Nontidal wetlands connected by surface flow and contiguous
to tidal wetlands, or water bodies with perennial flow.
D. Ponds located within the one-hundred-year floodplain.
E. A one-hundred-foot-wide vegetated buffer area located adjacent to and landward of the components listed in Subsections
A through
D above, and along both sides of any water body with perennial flow.
The Resource Management Area (RMA) is composed
of concentrations of the following land categories: floodplains; highly
erodible soils, including steep slopes; highly permeable soils; nontidal
wetlands not included in the RPA; and other lands Northumberland County
feels are necessary to protect the quality of state waters. The RMA
includes all areas of Northumberland County not included in the RPA.
The Chesapeake Bay Preservation Area Map references the general location of all CBPAs and should not be used to determine the exact location of these areas. Each request for any activity within the CBPAs shall be determined on a site-specific basis related to the property as required by §
54-15 through the review and approval of the plan of development process or as required under §
54-28 through the review and approval of a water quality impact assessment.
