It shall be unlawful for any person in or around any public place, whether or not on private property, to:
A. 
Loiter; defined as to linger idly or aimlessly in or about a place.
B. 
Refuse to identify himself or herself by name and address at the request of a uniformed police officer or of a properly identified police officer not in uniform, if the surrounding circumstances are such as to indicate to a reasonable man or woman that the public safety requires such identification.
A. 
A violation of this chapter with reference to § 88-1A shall be punishable as a Class 4 misdemeanor. A second or subsequent violation within one year shall be punishable as a Class 1 misdemeanor.
B. 
A violation of this chapter with reference to § 88-1B shall be punished as a Class 4 misdemeanor.[1]
