The Board of Trustees has determined that the health, safety, welfare
and good order of the residents of the village and the general public require
the proper coordination of auxiliary police activities and functions within
the village with the Nassau County Police Department and appropriate civil
preparedness authorities to ensure optimum performance of their duties during
times of civil defense emergencies and authorized auxiliary police drill periods.
To properly effect such coordination, it is deemed appropriate to establish
the office of Auxiliary Police Coordinator for the village and to compensate
said Coordinator for his services.
Unless otherwise expressly provided, the following words, for the purpose
of this chapter, shall have the meanings hereinafter indicated:
The coordinator appointed under authority of this chapter of the
Code.
The unit or other organization of auxiliary police established and
directed by the Nassau County Police Department pursuant to the New York State
Defense Emergency Act and serving only the territory encompassing the village.
The Board of Trustees hereby creates the office of Coordinator of Auxiliary
Police for the Village of Westbury.
A.
The Mayor, with the approval of the Board, shall appoint
as Auxiliary Police Coordinator a resident of Nassau County, 18 years of age
or older, who has had prior experience and training in the field of federal,
state or local law enforcement or as a peace officer or military police officer,
who is interested in the proper performance of auxiliary police forces within
the village and who is willing and able to devote adequate time and effort
to the performance of his duties as hereinafter specified.
B.
The initial term of Auxiliary Police Coordinator shall
commence with his appointment on approval by the Board and shall continue
until the annual meeting of the Board for the year 1979. Subsequent appointments
shall be made by the Mayor, with approval of the Board, at the annual meeting
of the Board and shall continue for a term of two years.[1]
C.
Vacancies in the office of Auxiliary Police Coordinator
occurring for reasons other than expiration of term of office shall be filled
by appointment of the Mayor, without Board approval, and the individual so
appointed shall serve for the remainder of the unexpired term of the Coordinator
originally appointed with Board approval.
A.
The Auxiliary Police Coordinator shall discharge the
following duties of office:
(1)
Advise the Mayor and Board with respect to all matters
affecting the proper organization, recruitment, training, funding, equipping,
provision of facilities, direction and operation of the auxiliary police forces
within the village.
(2)
Coordinate the activities of the auxiliary police forces
within the village with the appropriate commanders of the Nassau County Police
Department and assist and advise such auxiliary police forces in matters of
administration, funding and other aid furnished by the village and other levels
of government, as appropriate.
(3)
Recommend to the Mayor and Board and to the Nassau County
Police Department qualified candidates for the position of chief of auxiliary
police forces and other superior officers thereof within the village.
(4)
Make an annual report to the Board, on or before December
31 of each year, summarizing the activities of the auxiliary police forces
within the village during the preceding year, reflecting staffing levels,
training achievements, drills, police actions taken by force members, a current
roster of members by date of appointment, rank and training and other items
of interest, including any recommendations as to means of improving performance
of auxiliary police forces within the village, and recommend budget appropriations
for the succeeding year.
(5)
Make such other reports to the Mayor or Board as are
specifically requested.
(6)
Institute and maintain a system of property accountability
for all property and equipment furnished to auxiliary police forces within
the village in whole or in part from village funds or public subscriptions
and ensure that proper records are kept in connection therewith.
B.
The Coordinator shall be paid annual compensation for
his services, from funds appropriated therefor, in such amounts as the Board
may, by resolution, from time to time determine.
The Coordinator shall submit to the Board annually, with his annual
report, a proposed budget for auxiliary police purposes, and all expenses
of his office shall be paid from funds appropriated therefor.
Nothing herein contained shall be construed to confer upon the Coordinator
any police function or authority to control or direct auxiliary police forces
in the performance of duties assigned to them by the Nassau County Police
Department.
