A.
Appointment.
(1)
The Examining Board of Plumbers shall consist of five
persons who shall be residents of the County of Nassau and shall be
appointed in accordance with the provisions of § 3-312 of
the Village Law. Initial appointment of members of said Board shall
be for five years, four years, three years, two years and one year
respectively, and thereafter their successors shall be appointed annually
for the full term of five years. Members of said Board shall be master
or journeyman plumbers who shall have had not less than 10 years'
practical experience in the plumbing trade. Each member of the Board
shall be compensated at a per diem rate to be set by resolution of
the Board of Trustees for each day actually and necessarily spent
in the work of the Examining Board, not to exceed four in one calendar
month.

(2)
Meetings. The Board shall meet at least once each
month and may meet at such other times as, in the opinion of the Chairman
or a majority of the Board, are necessary for the effective discharge
of its business on six other dates annually. The Board shall meet
at the call of the Chairman. Notice of the meeting of the Board shall
be given by mailing notice of the time and place of the meeting, addressed
to each member at his last post office address, at least five days
before the time of such meeting.

Regulations. The Board shall make rules and regulations
for the conduct of its business as an Examining Board.
B.
Qualifications of plumbers. No person shall engage in the business of plumbing within the Village of Westbury until he shall obtain a certificate of competency or license from the Examining Board of Plumbers mentioned in Subsection A(1) of this section.
C.
Application for examination.
(1)
Any person applying for an examination for a certificate
to engage in the business or matter of employing plumbers shall, before
being examined, file with the Board an application on such forms as
may be prescribed by the Board and shall furnish to the Board such
information as it may require concerning the applicant's fitness and
qualifications to receive a certificate as aforesaid. All applications
must be under oath.
(2)
Each applicant shall be required to furnish two vouchers
who shall sign under oath, on forms prescribed by the Board, certifying
to the time the applicant has been employed by them as a journeyman
plumber or the period of time they have known such applicant as a
master or employing plumber. Such vouchers at the time of signing
the applications must be lawfully engaged in the plumbing business.
(3)
Any person desiring a master plumber's license shall
make an application in writing to the Examining Board of Plumbers,
which Board shall arrange for an examination of such applicant.
(4)
The Board shall refuse to receive an application from
any person who at the time of making application may be unlawfully
engaged in business as a master or employing plumber.
(5)
All applications shall expire and be canceled after
a period of one year if the applicant does not appear for examination
or reexamination within that period.
(6)
Examination will be required for each applicant, with
the exception of the following: Where the applicant is at the time
of making application a duly licensed master or employing plumber
in any other municipality in the State of New York, and shall submit
a certified copy of a certificate of competency issued by the Examining
Board of Plumbers in such municipality, and if he shall maintain his
principal place of business in such municipality, examination will
be waived, provided that such municipality has signified in writing
its willingness to reciprocate in like manner with the Examining Board
of Plumbers of the Village of Westbury. The fee, however, in such
cases shall be the same as for those requiring examination by the
Examining Board of Plumbers. Such applicant shall receive a license
only. No certificate of competency shall be examined by the Examining
Board of Plumbers of the Village of Westbury.
D.
Experience. No person shall be examined unless he
shall have had an experience of at least five years as journeyman
plumber and is able to furnish satisfactory evidence of such fact.
No applications will be received from any person who is not a citizen
of the United States.
E.
Examinations.
(1)
The examination of the Board shall be in two parts,
namely; a practical test to determine the applicant's skill as a journeyman,
and a written examination. The written examination shall consist of
questions and plan to determine the applicant's fitness and qualifications
to engage in the business of master or employing plumber.
(2)
All examinations shall be written by the applicant
and must be in English.
(3)
Time of holding examination shall be left to the discretion
of the Board. Ample notice shall be given to applicants.
(4)
Persons who pass the tests as prescribed by the Board
shall be eligible to receive a certificate of competency as master
or employing plumber.
(5)
An applicant who fails in the practical test shall
not be eligible for another test until the expiration of three months;
should he fail in the second test he will not be eligible for a third
test until the expiration of six months, and failing in the third
test he will not be eligible for a fourth test until the expiration
of one year. An applicant who fails in written examinations shall
not be eligible for reexamination until the expiration of one month;
should he fail in the second examination he will not be eligible for
another examination until the expiration of three months; should he
fail in the third examination he will not be eligible for another
examination until the expiration of six months, and should he fail
in the fourth examination he will not be eligible for another examination
until the expiration of one year.
F.
Fitness of applicant. Before issuing a certificate
to engage in the business of master or employing plumber, the Board
shall inquire into the applicant's fitness and qualifications for
conducting such business, and may require the applicant to submit
under oath such evidence, in addition to the examinations and tests
hereinbefore provided, as will satisfy the Board that he is a person
of good repute, character and responsibility and otherwise qualified
to engage in business as a master or employing plumber.
G.
Fees and licenses.

(1)
Each applicant for examination shall pay a fee of
$100 before said application can be reported to the Examining Board
of Plumbers. In case of applicant failing to pass the required average,
no part of this $100 can be claimed by applicant. Where an applicant
has paid this $100 for examination and failed, for each subsequent
examination he shall pay an additional fee to be fixed by the Board,
not to exceed $10.
(2)
All licenses issued to individuals whose last names
begin with the letters A through K shall expire on December 31 in
even years. All licenses issued to individuals whose last names begin
with the letters L through Z shall expire on December 31 in odd years.
During the month of December each year, all licensed plumbers whose
license is due to expire shall file application for renewal of license,
bond for ensuing license period and pay the renewal fee. The fee for
license renewals shall be in an amount as set from time to time by
resolution of the Board of Trustees and shall be payable at the time
of filing the application.
(3)
Any licensed plumber not securing his renewal on or
before the 31st of December of the year in which it expires shall
be required to make a new application, be reexamined and pay a fee
as is set from time to time by the Board of Trustees for such examination
and license.
(4)
The fees set forth herein may be revised by the Board
of Trustees by resolution.
H.
Duplicate certificates. In case a certificate of competency
is lost by the holder thereof, the Board may issue a duplicate for
the sum of $5. In other cases the Board shall issue a certificate
of record stating that the records of the office show that a certificate
was issued to a specific person. The charge for such certificate of
record shall be $2.
I.
Additional requirements. No certificate or duplicate
certificate of competency or license or renewal thereof shall be issued
by the Examining Board of Plumbers pursuant to this section unless
there shall be on file with the Examining Board of Plumbers the following:
(1)
An insurance certificate issued by an insurance company
authorized to do business in this state, running to the Village, confirming
that the applicant has obtained public liability insurance coverage
of not less than $100,000/$300,000 for personal injuries and property
damage insurance in the amount of not less than $50,000/$100,000 to
cover claims brought by any person for injury to person or property
resulting from or occasioned by any actionable negligent conduct by
the person to whom the certificate or duplicate certificate of competency
or license, or renewal thereof, shall be issued or by any person acting
on his behalf. Such insurance certificate must contain a statement
that in the event that said policy is canceled, not renewed or is
materially changed, at least 15 days' prior written notice of such
cancellation, failure to renew or material change will be given to
the Village.
(2)
A certificate of disability insurance and a certificate
of workmen's compensation insurance in such form and amount as are
acceptable to the Industrial Commissioner, evidencing the existence
of disability and compensation insurance coverages for employees of
the certificate or license holder or, in lieu thereof, an affidavit
stating that the certificate or license holder will not hire any employees.
A.
It shall be unlawful for any master or employing plumber
to commence or proceed with new plumbing or alteration to existing
plumbing until an application has been filed on forms provided and
a permit issued by the Superintendent of Buildings.
B.
Such application shall be accompanied by the required
fee and by plans drawn to scale, consisting of such floor plans and
elevations as may be necessary to show clearly all plumbing work to
be done, and must show partitions and methods of ventilating water
closet compartments.
C.
It shall be unlawful for any licensed plumber holding
a license from the Examining Board of Plumbers of the Village of Westbury
to sign an application and act as agent for a plumber who is not licensed
by said Examining Board of Plumbers.
D.
No modification of the approved application and plans
will be permitted unless an amended application and plans are filed
and approved by the Superintendent of Buildings.
E.
The permit fees for inspection on both new and alteration
work shall be as follows:
(1)
For the first three fixtures or less: $25 and $5 for
each additional fixture or any roughing providing for additional fixtures,
but the permit fee for each permit shall be not less than $25.
(2)
For oil burner units: $10 per unit.
(3)
For tanks: $10 per tank.
(4)
For gas burners: $10 for each gas unit.
(5)
For air-conditioning units: $10 per unit.
(6)
For sewer installations: $10 per installation.
(7)
For sprinkler fire control systems: $100 per system.
(8)
For standpipe fire control systems: $100 per system.
(9)
The fees set forth herein may be revised by the Board
of Trustees by resolution.
F.
Ordinary repairs to the plumbing system may be made
by a master plumber duly licensed in the Village of Westbury without
application to the Superintendent of Buildings. Such repairs, however,
shall not be construed to include additions to or alteration, replacement
or relocation of any standpipe piping, water-distribution piping,
house sewer, private sewer or drainage system, including leaders,
or any soil, waste or vent pipe. Such repairs are classified as "additions
and alterations" and shall not be made until application has been
made and permit granted.
G.
Where repairs include replacement or installation
of fixtures only, without addition to or alteration of existing piping,
a permit will not be required but written notice of repairs shall
be given to the Superintendent of Buildings before the same are commenced,
and the work shall be done in accordance with this article and/or
any rules and regulations prescribed by the Superintendent of Buildings.
H.
Repairs and alterations shall comply in all respects
with the weight, quality, arrangement and venting of the rest of the
work in the building. When an existing soil, waste or vent line has
been damaged by fire or other causes to the extent of 50% or more
of its entire length, said line must be replaced by new lines installed
in accordance with the rules and regulations governing new lines.
I.
Written notices must be given to the Superintendent
of Buildings by the plumber when any work is begun and at such time
as the work is ready for inspection.
When for any reason it may be impracticable
to comply strictly with the foregoing regulations, the Superintendent
of Buildings shall have power to modify the provisions so that the
spirit and substance thereof shall be complied with.
