No dwelling, garage or other building or outbuilding
shall be moved upon any highway or public place within the Village
unless a written permit has first been obtained from the Village Clerk
providing the time, manner and highways or public places through which
the buildings may move.
No permit shall be issued pursuant to this article
unless and until the required fee has been paid and there has been
deposited with the Village Clerk the sum of $5,000 or a bond in a
similar amount. In case of any damage to the highways or public places
within the Village, or to private property, the Village may repair
the same and deduct the cost thereof, plus an additional 25% of the
cost as a charge for administration expenses, from the amount of the
deposit, whereupon the balance shall be returned to the permittee.
In the event that there is, in the opinion of the Superintendent of
Public Works, no damage to any sidewalk, highway or public place or
to any private property as a result of the moving of the building,
the entire deposit shall be returned to the permittee. In the event
that the cost of repairing any and all damage to public and private
property shall exceed $4,000, the Village shall retain the entire
deposit and the permittee shall be liable for any excess over $4,000,
plus 25% of such excess as a charge for administration expenses, and
the permittee shall be liable in addition for all attorney's fees
and other expenses reasonably incurred in the collection of any amounts
due over and above the amount of deposit.
