As used in this article, the following terms shall have the meanings indicated:
LICENSED VEHICLE
A. 
A vehicle:
(1) 
For which a permit, of current validity, has been duly issued by the Village Clerk in accordance with the provisions of this article; and
(2) 
Which displays the said permit upon that part of the vehicle and in the manner designated by the license.
B. 
No vehicle shall be a licensed vehicle for the purposes of this article unless both requirements of this section are complied with.
A. 
Any resident of this Village may obtain, from the Village Clerk, a commuter parking license for any passenger motor vehicle with noncomercial plates, not including a taxicab or omnibus, of which he is the owner, by filing with the Clerk an application in such form as the Clerk shall provide and paying the required fee. Such permit shall not be assignable or transferable to any other vehicle, or to any other owner, and shall be valid only so long as the vehicle is owned by the same owner and said owner remains a resident of the Village and the vehicle remains registered at an address within the Village of Westbury. Each such permit shall be valid for no more than one calendar year commencing January 3 and extending through the following January 2, and shall bear upon it the year in which its validity commences.
B. 
Any employee or business owner of a business located in a Business or Industrial Zone of this Village may obtain, from the Village Clerk, a business parking license for any passenger motor vehicle with noncommercial plats, not including a taxicab or omnibus, of which he is the owner, by filing with the Clerk an application in such form as the Clerk shall provide and paying the required fee. Such permit shall not be assignable or transferable to any other vehicle, or to any other owner, and shall be valid only so long as the vehicle is owned by the same owner and said owner continues to either own a business or be an employee of a business located within a business or industrial zone in the Village of Westbury. Each such permit shall be valid for no more than one calendar year commencing January 3 and extending through the following January 2, and shall bear upon it the year in which its validity commences.
C. 
Replacement. When the owner of a licensed vehicle sells, destroys or otherwise disposes of the licensed vehicle, a new permit may be issued for another vehicle for the balance of the permit year, at a fee to be set by the Village Board, under the following conditions:
(1) 
The registration of the licensed motor vehicle shall have been transferred to the replacement vehicle and approved by the New York State Department of Motor Vehicles.
(2) 
The registration plate number of the replacement vehicle shall be the same as for the original licensed vehicle.
(3) 
An affidavit shall be filed with the Village Clerk certifying that the permit displayed on the original vehicle had been destroyed at the time of disposition.
D. 
Leased vehicles. A permit may be issued to a Village resident for use on a leased vehicle under the following terms and conditions:
(1) 
The application shall be accompanied by a sworn statement of the lessor and lessee that the vehicle is leased for the entire term of the licensing period.
(2) 
A sworn statement by the lessee that the vehicle is for the exclusive use of the resident applicant and will be garaged at the applicant's Village residence.
(3) 
The license shall be issued in the name of the Village resident, and he shall be liable for any improper use of said license.
The Commissioner of Police and Public Safety is authorized and required to designate the part or parts of a vehicle upon which permit shall or may be displayed, and the manner in which it shall or may be displayed. Such designations may be by order, rule or regulation, and a brief indication of such designation shall appear upon each permit issued pursuant to this article.
In case of loss or destruction of any permit issued pursuant to this article, the owner may obtain a replacement by filing an application with the Village Clerk, in such form as the Clerk shall provide, and paying the required fee, which shall be set by the Village Board. Such application shall set forth that the permit was lost or destroyed. After the issuance, pursuant to this section, of a replacement permit, the replaced permit shall no longer be valid.
It shall be unlawful and a violation of this article for any person to do any of the following acts:
A. 
To transfer or assign any license issued pursuant to this article.
B. 
To cause, allow or permit the display of a license issued pursuant to this article upon any vehicle registered in his name or of which he is the operator, unless it is a licensed vehicle.
C. 
To remove a license issued pursuant to this article from any licensed vehicle without the permission of the owner.
D. 
To alter or deface a license issued pursuant to this article, unless a still-valid license for said vehicle has been issued pursuant to this article.
E. 
To allow or permit any vehicle, other than a licensed vehicle, registered in the name of or operated by such person to stand or be parked in any parking spaces or parking areas designated pursuant to this article as "Restricted to Licensed Vehicles."
A. 
The Commissioner of Police and Public Safety is authorized and required to designate, by suitable signs and markings, parking spaces in the municipal parking lot maintained by the Village between Scally Place and Union Avenue in the village, said parking space to be designated "Restricted to Licensed Vehicles." All other parking space in the aforesaid municipal parking lot shall be designated by suitable signs and markings.
B. 
The Commissioner of Police and Public Safety is authorized and required to designate, by suitable signs and markings, parking spaces in the municipal parking lots maintained by the Village, said parking space to be designated "Licensed Business Vehicle Parking Permitted." All other parking space in the aforesaid municipal parking lots shall be designated by suitable signs and markings. Vehicles with a properly issued valid business parking license may park in locations as designated by the Commissioner of Police and Public Safety. It shall be unlawful and a violation of this chapter for any person to stop, stand or park a vehicle in any area in the municipal parking lots maintained by the village and designated "Licensed Business Vehicle Permitted" unless the vehicle bears a licensed business vehicle permit.
