No person shall make any connection with the public sewers or lay any drain to be connected with such sewers or open any street or public way for the purpose of allying or repairing any sewer or drain in connection with such sewers, within the Town, except a licensed drain layer, as provided in §
172-77, or a master plumber licensed to do work in the Town.
Applications for a license as a drain layer
shall be made to the Building Inspector upon a form furnished by him.
No such license shall be issued until the applicant therefor shall
have been examined by the Board of Examiners of Master and Journeyman
Plumbers, who shall determine that the applicant is a suitable and
competent person to receive such license and shall so certify to the
Building Inspector in writing upon such application. Upon receipt
of such approval, the Building Inspector shall thereupon issue to
such applicant a license upon the payment of a license fee of $10.
All such licenses shall expire upon the 31st day of March next following
their dates of issuance, unless sooner revoked. The fee for each renewal
thereof shall be $5 which shall be due and payable on or before the
first day of April in each year.
Before any such drain layer's license shall
be issued as herein provided, the applicant thereof shall file with
the Building Inspector a bond in the sum of $1,000 issued by a regular
indemnity or surety company authorized to do business in the state
conditioned substantially that the applicant shall indemnify and save
harmless the Town or any of its officers from all suits and actions
of every name and description brought against the Town or any officer
of the Town for or on account of any injury or damage received or
sustained by any person in consequence of or resulting from any work
performed by the applicant, his servants or agents, or of or from
any improper materials used in the work, or of or from any negligence
in guarding such work, or of or from any act or omission of the applicant,
his servants or agents; that the applicant shall comply in all respects
with all Town regulations concerning street openings now in effect
or which may hereafter be adopted.
No licensed drain layer shall make any opening
in any public street until he shall have applied for and secured from
the Director of Public Works or his authorized agent a permit for
doing such work in accordance with the provisions relating to street
openings in the Town.
No licensed drain layer shall connect any drain
or sewer upon or from any premises in the Town, or use or permit any
sewer or drain to be used, without having first obtained a permit
for making such connections from the Director of Public Works or his
authorized agent, in accordance with the provisions relating to the
sewer system in the Town and providing rules and regulations for connections
therewith.
Whenever, in the opinion of the Director of
Public Works or his authorized agent, any licensed drain layer violated
any of the provisions of this article or any rules, regulations and
specifications which may be adopted hereunder, he shall report the
same to the Building Inspector and if the Building Inspector shall
find the charges are well founded, he may revoke the license of such
drain layer. No person who having been once licensed to carry on the
business of drain laying in the Town who shall have violated any of
the provisions of this article or whose license shall have been revoked
as herein provided and shall have refused or neglected to make good
the satisfaction of the Town any defective or imperfect work or shall
have refused or neglected to pay any fees, fines or penalties imposed
under the provisions of this article shall not be eligible to receive
a renewal of such license until such default on his part shall have
been fully remedied and satisfied.
Any person who shall violate any provision of
this article shall, upon conviction, be fined not less than $50 nor
more than $10,000 for each and every offense.
