The following words, terms and phrases, when used in this article, shall
have the meanings ascribed to them in this section, except where the context
clearly indicates a different meaning:
MOTORBOAT
Includes any boat with either an inboard or an outboard motor, which
is powered by gasoline or any other fuel.
WATERS
Includes all lakes, rivers, streams, ponds or other bodies of water
located within or partly within the boundaries of the Town of Smithfield.
This article, relating to the operation of motorboats upon waters within
the boundaries of the Town, is adopted for the purpose of promoting the general
health, safety and welfare of the Town.
Motorboat operators shall obey lawful directions given to them by any
police officer or constable of the Town in the enforcement of the provisions
of the article and shall immediately upon being instructed by any police officer
or constable of the Town desist from any violation of this article.
No motorboat, while being operated upon waters within the Town, shall
pass closer to a bathing area on the shores of said waters than a distance
of 50 feet therefrom.

No person, while operating a motorboat upon waters within the Town,
shall engage in racing with any other boat.

No person shall operate any motorboat or vessel, or manipulate any water
skis, surfboard or similar device, in a reckless manner so as to endanger
the life, limb or property of another.

No person, who operates a motorboat on waters in the Town, shall operate
his motorboat at a rate of speed which endangers persons or property, and
he shall slow to a speed not exceeding eight miles per hour when passing other
boats which are not propelled by mechanical means.
