It shall be unlawful for any person, firm or corporation to conduct,
operate, maintain or use any piece or parcel of land in the Town of Hamburg
as a dump or a place for the reception and disposition of waste materials
for fill or final disposal without first having obtained for each such premises
a written permit from the Town Board. Owners of dumps presently existing at
the effective date of this Part 1 shall have a period of 90 days from such
effective date to obtain the permit required and to comply with the provisions
of this Part 1. Such permit shall continue for one year after the date of
issuance if not sooner revoked by the Town Board. Such permit shall not be
required for dumps owned by the town or any of its agencies.
For any and every violation of the provisions of this Part 1, the owner,
general agent or contractor of a building or premises where such violations
have been committed or shall exist, and the lessee or tenant or an entire
building or entire premises where such violation has been committed or shall
exist, and the owner, general agent, contractor, lessee or tenant or any part
of a building or premises in which part of such violation has been committed
or shall exist, and the general agent, architect, builder, contractor or any
person who knowingly commits, takes part or assists in any such violation
or who maintains any building or premises in which any such violation shall
exist, shall be liable, on conviction thereof, to a fine or penalty not exceeding
$25 for each and every offense, and whenever such person shall have been notified,
by the Inspector or by the service of a summons in a prosecution or in any
other way, that he is committing such violation after such notification, such
continued violation shall constitute a separate offense by a like fine or
penalty. Such fine or penalty shall be collected as like fine or penalties
are now by law collected.

Dumping fees shall be set for the Town of Hamburg residents using the
landfill site on Lakeview Road, Hamburg, New York. Said fees shall be set
periodically by resolution of the Hamburg Town Board.
