Every owner, lessee or occupant of any building, premises or place of business within the Town of Hamburg shall provide or cause to be provided at all times suitable and sufficient receptacles for receiving and containing garbage, rubbish or refuse that may accumulate or be used upon said premises. No receptacle shall exceed 20 gallons in capacity or 50 pounds in weight when filled, excepting in cases of mechanically operated containers furnished by the collector.
A. 
The owner or occupant of the real property shall be responsible for the regular collection and/or disposal of all refuse which may accumulate on the property owned or occupied by him.
B. 
No person shall accumulate or permit the accumulation of refuse on any premises owned by him within the Town of Hamburg, except for the purpose of collection, which shall normally occur at intervals not less frequent than every seven days.
C. 
Nothing herein contained shall be construed to prohibit the maintenance of compost or mulch piles, provided that no garbage is deposited in such piles, and further provided that such compost or mulch piles do not develop obnoxious odors, attract rodents or otherwise create a hazard to the health or enjoyment of neighboring property owners.

No person shall throw or deposit litter in or upon any private or public place except in public receptacles or authorized private receptacles for collection or at the town landfill, provided that public receptacles shall not be used by persons owning or occupying property in the vicinity of public receptacles for the deposit of domestic, commercial and industrial litter arising from the conduct of their activities.
A. 
Manner of placing litter in receptacles. Persons placing litter in public receptacles or in authorized private receptacles shall do so in such a manner as to prevent it from being carried or deposited by the elements upon any street, sidewalk or other public place or upon private property.
B. 
Littering from vehicles. No person, while a driver or passenger in a vehicle, shall throw or deposit litter upon any street or other public place within the town or upon private property.
C. 
Leaking or spilling loads. No person shall drive or move any truck or other vehicle within the town unless such vehicle is so constructed or loaded as to prevent any load, contents or litter from being blown or deposited upon any street, alley, mall or other public place.
D. 
Parks and recreation areas. No person shall throw or deposit litter in any park, playground or recreation area except in public receptacles and in such a manner that the litter will be prevented from being carried or deposited by the elements upon any part of the park or upon any street, mall or other public place. Where public receptacles are not provided, all such litter shall be carried away from the park, playground or recreation area by the person responsible for its presence and properly disposed of elsewhere as provided herein.
E. 
Posting of notices on lampposts and other structures. No person shall post or affix any notice, poster or other paper or device, calculated to attract the attention of the public, to any lamppost, public utility pole or shade tree or upon any public structure or building, except as may be authorized by the owners thereof or as required by law.
F. 
Violations and penalties.
(1) 
Maximum penalty. For violation of any provision of this Part 2, the maximum penalty shall, upon conviction thereof, be a fine not exceeding $250 or a term of imprisonment not exceeding 10 days, or both, in the discretion of the court.
(2) 
Separate violations. Except as otherwise provided, each and every day in which a violation of any provision of this Part 2 exists shall constitute a separate violation.
