Uses and structures permitted in the R-4 District are as follows:

B. 
Accessory uses and structures:
(1) 
Accessory uses and structures as permitted and regulated in the R-3 District for areas outside a licensed mobile home court.
(2) 
Within a licensed mobile home court: as provided for by Chapter 165 of the Code of the Town of Hamburg.[2]

Satellite dish antennas, provided that they are of a dull finish and located as close to the main structure in the rear yard and as far from property lines as possible or an antenna for use by the park approved by the Planning Board.

Unless otherwise provided, the minimum lot size in the R-4 District shall be as specified in this section.
A. 
Within a licensed mobile home court: dimensions for uses therein shall be as provided for by Chapter 165 of the Code of the Town of Hamburg.
B. 
Lot area and lot width at the building line for uses located outside a licensed mobile home court:
(1) 
Lot area:
(a) 
Minimum:

Eight thousand one hundred twenty-five square feet, provided that the lot is served by a public sanitary sewer.
(b) 
Two-family dwellings:
[1] 
Five thousand square feet per dwelling unit, provided that the lot is served by a public sanitary sewer.
(c) 
Three-or-more-family dwellings, not to exceed three stories: no minimum lot size. Density and maximum lot coverage shall be determined based on compliance with all other minimum setback requirements of this section. The parcel of land for a permitted use shall be sufficient in size to adequately accommodate all buildings, required off-street parking, landscaping and other accessory uses as dictated by all other bulk/setback regulations.

(d) 
Three-or-more-family dwellings over three stories in height: no minimum lot size. Density and maximum lot coverage shall be determined based on compliance with all other minimum setback requirements of this section. The parcel of land for a permitted use shall be sufficient in size to adequately accommodate all buildings, required off-street parking, landscaping and other accessory uses as dictated by all other bulk/setback regulations.

(2) 
Lot width at the building line:
(a) 
Where a lot is served by a public sanitary sewer: 65 feet for one dwelling unit, plus an additional 15 feet for a second dwelling unit and an additional 20 feet for each dwelling unit over two, but need not exceed 200 feet.
(3) 
Lot width at the front lot line: 25 feet.
Unless otherwise provided, the maximum height of buildings in the R-4 District shall be as specified in this section.

B. 
Buildings located outside a licensed mobile home court:
(1) 
Single-family or two-family dwellings: 21/2 stories, not to exceed 35 feet.
(2) 
Other principal buildings: as regulated by yard requirements.
(3) 
Accessory buildings: one story, not to exceed 18 feet.
Unless otherwise provided, the minimum required yards and other open spaces in the R-4 District shall be as specified in this section.

Area within a licensed mobile home court: as provided for by Chapter 165 of the Code of the Town of Hamburg.
B. 
Lots located outside a licensed mobile home court:
(1) 
Front yard: 35 feet.
(2) 
Side yards: two required.
(a) 
Single-family dwellings where the lot is served by a public sewer: The minimum width of any side yard shall be 10 feet.

(b) 
Two-family dwellings where the lot is served by a public sanitary sewer: The minimum width of any side yard shall be 10 feet.
(c) 
Single-family or two-family dwellings where the lot is not served by a public sanitary sewer. The minimum width of any side yard shall be 10 feet. The total minimum width of both side yards shall be 25 feet.
(d) 
Open space between principal buildings on a single lot. No vertical wall of a principal building shall be nearer to a vertical wall of another principal building than a distance of 30 feet or a distance equal to the average height of such vertical walls measured from adjoining finished grade, whichever is greater.
(3) 
Rear yard. Except as otherwise provided, no rear yard shall have a depth of less than 30 feet or a distance equal to the height of the principal building, whichever is greater.
(4) 
Three-or-more-family dwellings, not to exceed three stories in height, shall be a minimum of 50 feet from any property line.
(5) 
Three-or-more-family dwellings over three stories in height shall be a minimum of 50 feet from any property line, with an additional one foot for each additional foot exceeding 35 feet in height.
(6) 
Open space between principal buildings on a single lot. No vertical wall of a principal building shall be nearer to a vertical wall of any other principal building than a distance of 30 feet or a distance equal to the average height of such vertical walls measured from the adjoining finished grade, whichever is greater.
