The subdivider shall comply with the notification and signage requirements set forth in Article
XV of the Zoning Ordinance entitled "Public Notice: Signs and Notification."
Should any section or provision of these subdivision
regulations be declared by a court of competent jurisdiction to be
invalid, such decision shall not affect the validity of the regulations
as a whole or any other part thereof.
These subdivision regulations and any amendments
thereto shall take effect immediately upon approval by the Municipal
Board after adoption by the Planning Board. However, any subdivision
for which the final plat was approved by the Planning Board prior
to the approval of these regulations by the Municipal Board shall
be permitted to be completed under the provisions of the subdivision
regulations existing at the time of approval of the final plat.
The Planning Board shall have the authority
to modify or waive, subject to appropriate conditions, any provision
of these subdivision regulations as, in its judgment of the special
circumstances of a particular subdivision, is not requisite in the
interest of the public health, safety and general welfare, except
where such authority would be contrary to other local ordinances or
state laws.
