Pursuant to § 20(2) of the Town Law, the Town Board shall appoint a Town Attorney, to serve at the pleasure of said Board. The Town Attorney shall be an attorney at law of New York and be admitted to the practice of law in the courts of New York.
The Town Attorney shall have the following duties:
A. 
To prosecute and defend all actions which may be brought by or against the Town of Kent, the Town Board thereof or by or against any Town officer or officers for or by reason of any matter or duty connected with or growing out of their respective offices, or in which the Town is interested, in any court or tribunal.
B. 
To draw all the deeds, leases, conveyances, bonds, contracts, agreements and other legal instruments of whatever nature necessary in any matter relating to the business or interest of the Town, and all such ordinances as may be required of him by the Town Board or any committee thereof.
C. 
From time to time, when required, to advise the Supervisor, the Town Board, any committee thereof or any Town officer upon all matters relating to the business or interest of the Town which may be submitted to him for his opinion, and, when requested so to do, to give his opinion in writing. Said opinion, when in writing, shall be filed with the Town Clerk when given to the Town Board or any committee thereof, or in the office of the Supervisor or other Town officer requesting same, respectively.
Pursuant to § 20(2) of the Town Law, the Town Board may appoint such assistant attorneys or additional counsel as it shall deem necessary from time to time.
At the conclusion of his service to the Town, said Town Attorney, Assistant Town Attorney or additional counsel shall surrender to the Town Board all documents and other information belonging to the Town of Kent.
