Motor vehicles with a gross weight in excess of five tons, including any load, cargo or materials that are being carried, are hereby excluded from the following highways within the Town of Kent:
A. 
Barrett Hill Road in Lake Carmel, from its intersection with Route 52 to its intersection with Horsepound Road.
B. 
Dykeman Road, from the Town of Carmel line to its intersection with Nichols Street.
C. 
Mt. Nimham Road from Allen corners to its intersection with Farmers Mills Road.
D. 
Sagamore Drive, from its intersection with Route 301 to the end of the pavement at Old Forge Bridge.
E. 
The entire length of Dixon Road.
F. 
The entire length of North Horsepound Road.

Any motor vehicle and load exceeding the weight limits imposed in § 72-4 or 72-5 of this chapter shall be permitted to travel on the above-mentioned roads for the purpose of making local deliveries on said road(s).
Any person convicted of a violation of this Article shall, upon conviction, be subject to a fine of not more than $50 or imprisonment for not more than 15 days, or both, for the first offense; a second conviction within 18 months thereafter shall be punished by a fine of not more than $100 or by imprisonment for not more than 45 days, or both; a third or subsequent conviction within 18 months of the first conviction shall be punished by a fine of not more than $250 or by imprisonment for not more than 90 days, or both.
