This Part 2 shall be known and cited as the
"City of Ithaca Mobile Home Ordinance."
It is the purpose of this Part 2 to promote
the health, safety, comfort, convenience and general welfare of the
community, to protect and preserve the property of the City of Ithaca,
New York, and its inhabitants and to promote the economical and orderly
development and utilization of land by regulating mobile homes and
providing for planning and operating of mobile home parks and the
standards and regulations necessary to accomplish these purposes.
As used in this Part 2, the following terms
shall have the meanings indicated:
DEVELOPER
The mobile home park developer, owner or operator.
HEALTH AUTHORITY
The legally designated health authority or the authorized
representative of the Tompkins County Health Department.
INTERNAL STREET
A paved road, constructed of concrete, asphalt, paving brick
or other durable material, which shall be well-drained under normal
use and weather conditions. Pavement edges shall be protected to prevent
raveling of the surface and shifting of the base. Street surfaces
shall be maintained free of cracks, holes, dust and other hazards.
MOBILE HOME
A transportable, single-family dwelling unit suitable for
year-round occupancy and containing the same conveniences as immobile
housing with respect to water supply, light, heat, power and waste
disposal. A mobile home is a portable unit designed and built to be
towed on its own chassis, comprised of frame and wheels, connected
to utilities and designed without a permanent foundation for year-round
living. A unit may contain parts that may be folded, collapsed or
telescoped when being towed and expanded later to provide additional
cubic capacity, as well as two or more separately towable components
designed to be joined into one integral unit capable of being again
separated into the components for repeated towing. Mobile units can
be designed to be used for residential units; excluding, however,
travel trailers, motorized homes, pickup coaches and camping trailers.
A mobile home shall not include a travel trailer which is towed by
an automobile, can be operated independently of utility connections,
is limited in width to eight feet and in length to 32 feet and is
designed to be principally used as a temporary dwelling, nor shall
it include modular housing.
MOBILE HOME LOT
A parcel of land for the placement of a single mobile home
and the exclusive use of its occupants, and it shall be situated only
in a mobile home park as herein described.
MOBILE HOME PARK
A parcel of land under single ownership which has been planned
and improved for the placement of mobile homes for nontransient use
consisting of not less than five acres and not less than 25 mobile
home lots.
MOBILE HOME STAND
That part of an individual mobile home lot which has been
reserved for the affixed placement of the mobile home, appurtenant
structures or additions. The mobile home stand shall be provided with
anchors and tie-downs, such as cast-in-place concrete dead-men, eyelets
imbedded in concrete foundations, screw augers, arrowhead anchors
or other devices capable of securing the stability of the mobile home.
Anchors and tie-downs shall be placed at least at each corner of the
mobile home stand.
PERMIT
A written permit issued by the municipality permitting the
construction, alteration or extension of a mobile home park under
the provisions of this Part 2 and regulations issued hereunder.
PERSON
Any individual, firm, trust, partnership, public or private
association or corporation.
SERVICE OR RECREATIONAL BUILDING
A structure housing operational, office, recreational, park
maintenance, laundromat and other facilities built to conform to required
local standards.
All mobile homes, accessory buildings and appurtenant
structures and materials, assemblies and equipment utilized in connection
therewith shall comply fully with American National Standards Institute
(ANSI) Standard A 119.1 for mobile homes, applicable statutes of the
State of New York and orders, rules and regulations issued by authority
thereof. In the event of a conflict between or among laws, ordinances
or regulations, that law, ordinance or regulation which is the more
restrictive or establishes a higher standard shall prevail.
