This article shall be referred to as the "Bias-Motivated
Crimes Law."
Whenever used in this article, the following
terms are defined as follows:
DISABILITY
A.
Physical, mental or medical impairment resulting
from anatomical, physiological or neurological conditions which prevents
the exercise of a normal bodily function or is demonstrable by medically
accepted clinical or laboratory diagnostic techniques; or
B.
A record of such an impairment; or
C.
A condition regarded by others as such an impairment.
GENDER IDENTITY OR EXPRESSION
When one's perception of self is different from their assigned
sex at birth. External appearance of one's gender identity, usually
expressed through behavior, clothing, haircut or voice, and which
may or may not conform to socially defined behaviors and characteristics
typically associated with being either masculine or feminine.

GRAFFITI
Any inscription, word, figure, painting or other defacement
that is written, marked, etched, scratched, sprayed, drawn, painted
or engraved on or otherwise affixed to the surface of public or private
property with intent to damage such property.
The invalidity of any provision of this article
shall not affect the validity of any other provision which can be
given effect without such invalid provision.
This law will take effect immediately upon filing
with the Secretary of State of the State of New York.
