This chapter shall be known as the "Regulation, Storage and Use of Fireworks Law of the Town of Ossining."
The Town Board of the Town of Ossining hereby adopts regulations for the storage and use of fireworks for that portion of the Town of Ossining which is not within any incorporated village. These provisions are adopted to protect the health, safety and welfare of the residents of the Town of Ossining pursuant to the provisions of § 130, Subdivision 5, of the Town Law and Article 405 of the Penal Law.
For the purposes of a permit authority, the Town Board hereby designates the Town Board as the agency authorized to grant and issue permits for any fireworks which are to be displayed.
The permit authority of the Town of Ossining may, upon application in writing, grant a permit for the public display of fireworks by municipalities, fair associations, amusement parks or organizations of individuals and may impose any condition necessary to protect the health, safety and welfare of the community.

All applications for permits for the public display of fireworks shall be made at least 30 days in advance of the date of display, and the permit shall contain provisions as to the means and method of display pursuant to § 405.00, Subdivision 3, of the Penal Law. No permit granted and issued hereunder shall be transferable.
Before granting and issuing a permit for a public display of fireworks, the permit authority shall require an adequate bond from the applicant pursuant to § 405.00, Subdivision 4, of the Penal Law and shall refer the application to the Fire Chief, who shall make, or cause to be made, an inspection, and if in the judgment of the Fire Chief it would not be hazardous to persons or property, he shall approve and return such application to the permit authority.
Any possession or use of fireworks without a permit as provided herein in violation of this chapter shall be dealt with pursuant to §§ 270.00 and 405.05 of the Penal Law.
