The words and phrases used in this article shall for the purpose of
this article have the meanings respectively ascribed to them by Article 1
of the Vehicle and Traffic Law of the State of New York.
A.
The parking of vehicles is hereby prohibited on all highways
within the Town of Cortlandville between 1:00 a.m. and 7:00 a.m. from November
1 to May 1.
B.
The provisions of this section shall apply except when
it is necessary to stop a vehicle to avoid conflict with other traffic or
in compliance with the directions of a police officer or official traffic
control device.

A.
Parking spaces for the handicapped as provided for in
§§ 1203-a and 1203-c of the Vehicle and Traffic Law of the
State of New York shall also be extended to a motor vehicle registered in
accordance with § 404-a of the Vehicle and Traffic Law of the State
of New York. A handicapped permit issued in accordance with the provisions
of § 1203-a of the Vehicle and Traffic Law of the State of New York
shall entitle the driver to park in such parking spaces. Parking spaces for
the handicapped shall be those parking spaces accorded to a holder of a handicapped
parking permit provided in accordance with § 1203-a or as provided
in § 404-a of the Vehicle and Traffic Law of the State of New York.
B.
It shall be a violation for any person to stop, stand
or park a vehicle in any area designated as a place for handicapped parking
unless the vehicle bears a permit or a registration issued pursuant to the
provisions of the Vehicle and Traffic Law of the State of New York, and such
vehicle is being used for the transportation of a severely disabled or handicapped
person.
C.
Any person who parks in spaces clearly marked for use
by the handicapped in accordance with this section, without a special municipal
parking permit or whose motor vehicle is not registered in accordance with
§ 404-a of the Vehicle and Traffic Law of the State of New York
and being used for the transportation of a handicapped person, shall be subject
to a fine of not less than $25 nor more than $50 for the first offense and
not less than $50 nor more that $150 for the second offense occurring within
a period of two years within the same municipality. The arresting or ticketing
officer shall issue a summons to violators of this section.
D.
As used in this section, the term "handicapped" shall
also include "severely disabled person" as defined in § 404-a of
the Vehicle and Traffic Law of the State of New York.
A.
When any vehicle is parked or abandoned on any highway
within the town during a snowstorm, flood, fire or other public emergency
or during hours prohibited by this article which affects that portion of the
public highway upon which said vehicle is parked or abandoned, said vehicle
may be removed by or at the direction of the Town Highway Superintendent.
B.
When any vehicle is found unattended on any highway within
the town where said vehicle constitutes an obstruction to traffic, said vehicle
may be removed by or at the direction of the Town Highway Superintendent.
C.
When any vehicle is parked or abandoned on any highway
within the town where stopping, standing or parking is prohibited, said vehicle
may be removed by or at the direction of the Town Highway Superintendent.
After removal of any vehicle as provided in this article, the Town Highway
Superintendent may store such vehicle in a suitable place at the expense of
the owner. Such owner, or person in charge of the vehicle, may redeem the
same upon payment of the amount of all expenses actually and necessarily incurred
in effecting such removal. Removal charges shall not exceed $50, and storage
charges shall not exceed $5 per day or fraction thereof.
The Town Highway Superintendent shall without delay report the removal
and the disposition of any vehicle removed as provided in this article to
the Cortland County Sheriff, and it shall be the duty of the Town Highway
Superintendent to ascertain to the extent possible the owner of the vehicle
or person having the same in charge and notify him of the removal and disposition
of such vehicle and of the amount which will be required to redeem the same.
Every person convicted of a traffic infraction for a violation of any
provision of this article which is not a violation of any provision of the
Vehicle and Traffic Law of the State of New York shall be punished by a fine
of not more than $100 or by imprisonment for not more than 15 days, or by
both such fine and imprisonment.
