As used in this article, the following terms
shall have the meanings indicated:
Includes solely one-hundred-percent aluminum beverage containers.
Includes tree branches and limbs and consists of all tree
waste.
Includes all aluminum cans, glass, tin cans and plastic.
Includes corrugated cardboard boxes along with their corrugated
cardboard compartments and liners contained therein.
Includes clear, brown and green glass. Expressly excluded
are blue, window pane, milk white, mirrored and safety glass. All
glass must be rinsed.
Includes grass clippings and garden refuse.
Includes plastic beverage containers and bleach containers.
All containers must be rinsed and caps removed.
Includes all residential, commercial and institutional entities
which produce solid wastes and/or recyclable materials within the
boundaries of the Borough of Paramus.
Includes that portion of the total municipal solid waste
stream which is to be disposed of at a landfill or resource recovery
plant.
Includes one-hundred-percent tin cans. Expressly excluded
are paint cans. All tin cans must be rinsed and labels removed.
Includes paper of the type commonly referred to as "newsprint"
and distributed at stated intervals, usual daily or weekly, having
printed thereon news and opinions and containing advertisements and
other matters of public interest. Expressly excluded, however, are
all magazines or similar periodicals, as well as all other paper products
of any nature whatsoever.
There is hereby established a program for the
collection of used newspapers, corrugated cardboard, aluminum cans,
glass, tin cans, plastic, grass and brush, as herein defined, within
the Borough of Paramus for the purpose of resale or disposal of the
same by the Borough of Paramus for recycling purposes.
It shall be mandatory for all persons who are
owners, lessees and occupants of premises in the Borough of Paramus
to separate used newspapers, corrugated cardboard, aluminum cans,
glass, tin cans, plastic, grass and brush from all other solid waste
produced on such premises. Said used newspapers, corrugated cardboard,
aluminum cans, glass, tin cans, plastic, grass and brush separated
for recycling purposes shall not be considered part of solid wastes,
as defined herein.
Said newspapers, corrugated cardboard, aluminum
cans, glass, tin can, plastic, grass and brush separated for recycling
purposes shall be collected by the following methods:
A.Â
Borough residents shall place commingled glass, aluminum
cans, tin cans and plastic in one container. Borough residents shall
place used newspapers and corrugated cardboard in separate containers
at the curb for collection on such days, at such times and in such
manner as shall be designated by the Paramus Recycling Coordinator
and the Paramus Department of Public Works. Borough residents shall
place grass in separate containers with handles and covers at the
curb for collection on such days, at such times and in such manner
as shall be designated by the Paramus Recycling Coordinator and the
Paramus Department of Public Works. Borough residents shall tie and
bundle brush with cord for collection with limbs not to exceed four
inches in diameter and bundles not to exceed four feet in length.
Collection shall be on such days, at such times and in such manner
as shall be designated by the Paramus Recycling Coordinator and the
Paramus Department of Public Works.
B.Â
The Borough's commercial and institutional entities
shall separate used newspapers, high-grade office paper, corrugated
cardboard and aluminum cans, tin cans, glass and plastic and submit
to the Borough a method for their collection.
C.Â
It is required that proposals for new developments
of 50 or more single-family units, 25 multifamily units or commercial/industrial
space of 1,000 square feet or more incorporate provisions for recycling.
Condominiums shall provide a separate method of collection and submit
recycling plans to the Borough Recycling Coordinator for approval.
D.Â
Under this article, used newspapers, corrugated cardboard,
aluminum cans, glass, tin cans and plastic may be brought directly
to the Paramus Recycling Center or disposed of by any other lawful
means along with other recyclable materials; provided, however, that
in no event shall the same be disposed of with solid wastes. However,
commercial and institutional entities shall obtain prior approval
from the Paramus Recycling Coordinator in order to do so.
E.Â
Leaves cannot be put into the waste stream (garbage
or trash going to the landfill) specifically during the period of
September 1 through December 31. Homeowners are required to set out
loose, unbagged leaves in the curbline for separate pickup for composting
during the period of September 30 to December 1 by the Department
of Public Works.
F.Â
Grass cannot be put into the waste stream (garbage
or trash going to the landfill) specifically during the period of
April 1 through October 1. Homeowners are required to put grass in
containers with handles and covers or into biodegradable paper bags
(no plastic bags) on the curbline for separate pickup for composting
during the period of April 1 through October 1. After October 1, grass
may be mixed with leaves and placed on the curbline.
G.Â
Brush cannot be put into the waste stream (garbage
or trash going to the landfill). Homeowners are required to tie limbs
not to exceed four inches in diameter and bundles not to exceed four
feet in length and place them on the curbline.
H.Â
Methods of pickup are to be established by the Department
of Public Works. For reasons of safety, residents on main thoroughfares,
as listed below, must place loose and unbagged leaves on the top of
the curb and not in the street:

From the time of placement at the curb or other
designated pickup areas of used newspapers, corrugated cardboard,
aluminum cans, glass, tin cans and plastic by any person for collection
by the Borough of Paramus or other authorized haulers, such used newspapers,
corrugated cardboard, aluminum, glass, tin cans, plastic, grass and
brush shall be and become the property of the Borough of Paramus.
It shall be a violation of this article for any person or hauler unauthorized
by the Paramus Recycling Coordinator to collect or pick up or cause
to be collected or picked up any such used newspapers, corrugated
cardboard, aluminum cans, glass, tin cans, plastic, grass and brush
for any purpose whatsoever, except that the Mayor and Council may
authorize from time to time certain charitable nonprofit organizations
to collect aside used newspapers, corrugated cardboard, commingled
aluminum cans, glass, tin cans, plastic, grass and brush curbside
subject to the schedule established by the Paramus Recycling Coordinator.
Any and each such collection in violation hereof from one or more
premises shall constitute a separate and distinct offense punishable
as hereinafter provided.
The Mayor and Council shall appoint a Recycling
Coordinator to serve for a period of one to five years as they may
direct and shall from time to time effect the sale or disposal of
the materials so collected hereunder for recycling purposes. Any revenues
derived therefrom shall accrue to the Paramus Environmental Commission.
The Paramus Recycling Coordinator and the Department
of Public Works are hereby authorized and directed to establish and
promulgate reasonable curbside collection schedules subject to approval
by resolution of the Mayor and Council as to the manner, days and
times for the collection of used newspapers, corrugated cardboard,
aluminum cans, glass, tin cans, plastic, grass and brush, in accordance
with the terms hereof.
A.Â
Effective April 1, 1991, it shall be mandatory for
all owners, lessees and occupants of business and/or commercial properties
to separate corrugated cardboard, glass bottles (color separated),
food waste, high-grade paper and ferrous scrap produced by such business
or commercial properties for private collection/deposit and the ultimate
recycling of said material.
C.Â
Separation, collection and disposal methods of recyclable
materials.
(1)Â
Aluminum shall be separated and disposed of by either
private scavenger or disposed of in areas provided at the Municipal
Recycling Center with prior authority by the Municipal Recycling Coordinator.
(2)Â
Automotive waste oil shall be separated and disposed
of by a private scavenger.
(3)Â
Corrugated cardboard shall be separated and disposed
of either by a private scavenger or in an area provided at the Municipal
Recycling Center with prior authority from the Municipal Recycling
Coordinator.
(4)Â
Ferrous metal and white goods shall be separated and
disposed of by private scavenger.
(5)Â
Food waste shall be separated and disposed of by private
scavenger.
(6)Â
Glass (color separated) shall be disposed of by either
private scavenger or disposed of in receptacles provided at the Municipal
Recycling Center with prior authority by the Municipal Recycling Coordinator.
(7)Â
High-grade office paper shall be separated and disposed
of by private scavenger.
(8)Â
Leaves shall be separated and disposed of by private
scavenger.
(9)Â
Grass shall be separated and disposed of by private
scavenger.
(10)Â
Newspaper shall be separated and disposed of
by private scavenger.
(11)Â
Tin cans shall be separated and disposed of
by private scavenger.
(12)Â
Plastic shall be separated and disposed of by
private scavenger.
D.Â
Registration requirements. It shall be the responsibility
of all owners, lessees and occupants of business and/or commercial
properties to register annually with the Municipal Recycling Coordinator
on forms provided by the Borough. The annual registration must be
filed with the Recycling Coordinator on or before January 10 of each
year. New businesses and/or commercial properties must file within
45 days of the issuance of a certificate of occupancy.
E.Â
Reporting requirements. It shall be the responsibility
of owners, lessees and occupants of business and/or commercial properties
to report semiannually to the Recycling Coordinator on or before March
1 for the preceding six-month period of July 1 through December 31
and on or before September 1 for the preceding six-month period of
January 1 through June 30 the quantities of materials recycled in
a letter from a generating agency, on its letterhead and signed by
an authorized agency representative, which includes type and quantity
of materials sold, dates of sale, and name of market, or a letter
from a market, on its letterhead and signed by an authorized representative,
which includes type and quantity of material and the date received.
F.Â
Exemptions. Exemption from mandatory municipal recycling
may be requested by any owner, lessee or occupant of business and/or
commercial properties of the Recycling Coordinator. A request for
exemption must be made, in writing, on the prescribed form and submitted
to the Recycling Coordinator.
G.Â
Private scavenger contracts. If the commercial user
is either unable or unwilling to secure a market and collector for
designated mandatory recyclable materials, the Borough of Paramus,
through its Recycling Coordinator, may secure such markets and enter
into contracts on behalf of the commercial user for the collection
and disposal of designated recyclable materials; provided, however,
that the commercial user shall be responsible for any and all expenses
associated with said contract.
A.Â
Effective April 1, 1991, it shall be mandatory for
all private, public and governmental institutions and buildings to
separate high-grade office paper produced by such institutions for
private collection and the ultimate recycling of materials.
B.Â
High-grade office paper shall be separated and disposed
of by private scavenger.
C.Â
Private scavenger contracts. If the institutional
user is either unable or unwilling to secure a market and collector
for mandatory recyclable materials, the Borough of Paramus, through
its Recycling Coordinator, may secure such markets and enter into
contracts on behalf of the institutional user for the collection and
disposal of designated recyclable materials; provided, however, that
the institutional user shall be responsible for any and all expenses
associated with said contract.
Nothing in this article shall be deemed to prohibit
any owner, lessee or occupant of residential property of disposing
of recyclable materials privately through a sale or gift, provided
that in no event shall such recyclable materials be left at the curb
for any private pickup and further provided that in no event shall
any such recyclable materials be disposed of as trash.
The responsibility for enforcement of the provisions
of this article shall rest with the Paramus Recycling Coordinator
and/or or his designee who shall have the power of issuing summonses
to anyone violating this article and who shall coordinate his enforcement
efforts with the Department of Public Works and such other Borough
agencies as may be necessary.
A.Â
Any person, firm or corporation who violates or neglects to comply with any provision of this article other than the provisions set forth in § 379-21 shall, upon violation, be issued a written warning, and any further conviction thereof shall be punishable by a fine of $25 for the first offense, $50 for the second offense, $100 for a third offense and a sum not to exceed $500 for any offense thereafter.
B.Â
Any person, firm or corporation who violates or neglects to comply with the provisions of § 379-21 of this article (commercial users) shall, upon violation, be issued a written warning, and any further conviction thereof shall be punishable by a fine of $50 for the first offense, $100 for the second offense, $200 for a third offense and a sum not to exceed $500 for any offense thereafter.

Definitions. The following terms shall have the assigned
definitions under this section:
Borough of Paramus.
Comprise batteries made of silver oxide, mercuric oxide,
lithium, zinc air and alkaline manganese.
Nonrechargeable alkaline, rechargeable alkaline and button
cells.
Comprise car, motorcycle and marine batteries.
Also known as "common cells," comprise alkaline, zinc and
lithium battery types in sizes D, C, AA, AAA, nine-volt and lantern
sizes.
Also known as "nickel-cadmium batteries," comprise rechargeable
batteries commonly built into rechargeable appliances but also available
in common cell sizes.
The recycling center maintained by the Borough Environmental
Commission, currently located behind the Department of Public Work
on Jockish Square.
B.Â
Requirements.
(1)Â
Borough residents shall only discard household-generated
batteries and lead-acid batteries at the Borough Recycling Center.
No curbside pickup will be provided for the above-identified batteries.
(2)Â
The Borough shall maintain separate receptacles for
household batteries and lead-acid batteries at the Borough Recycling
Center which meet or exceed the requirements for the storage of hazardous
waste containers pursuant to N.J.A.C. 7:26-10.4. The receptacles are
only for use by Paramus residents.
C.Â
Penalties. Noncompliance, either intentional or negligent,
with § 367-26B(1) will result in the assessment of a fine
of $50 per battery found in a Borough resident's trash and/or recycling
receptacle serviced by the Borough's Department of Public Works or
other similar Borough entity responsible for the pickup of Borough
residents' trash.
