GENERAL REFERENCES
Alcoholic beverages — See Ch.
113.
The Board of Alcoholic Beverage Control, as heretofore established,
is hereby continued.
A. The Board shall be comprised of three (3) members, not
more than two (2) of whom shall be of the same political party.
B. The members shall be appointed by the Mayor with the
advice and consent of the Council.
A. Each member shall serve for a term of three (3) years,
provided that of those first appointed, one (1) shall be appointed to a term
of one (1) year, (1) one for two (2) years and one (1) for three (3) years.
B. Vacancies shall be filled in the same manner as the original
appointment for the remainder of the unexpired term.
Members shall serve without compensation but may be reimbursed for necessary
expenses incurred in the performance of their duties.
Any member may be removed by the Mayor for cause, after reasonable notice
and an opportunity to be heard.
A. The Board, with the approval of the Council, shall appoint
a Secretary, who shall hold office during good behavior.
B. Before entering upon the duties of his office, the Secretary
shall furnish a bond to the city in the sum of twenty-five thousand dollars
($25,000.) for the faithful performance of his duties. The bond shall be approved
by the Corporation Counsel as to form and by the Board as to sufficiency and
filed with the City Clerk.
C. The Secretary of the Board shall:
(1) Keep an accurate record of the proceedings of the Board
and enter the same upon the minutes.
(2) Receive all applications for alcoholic beverage licenses
and transfers and accept the lawful fees therefor.
(3) Remit all fees received by him to the City Treasurer
at the close of each day and obtain a receipt therefor.
(4) Issue such licenses as the Board may direct and keep
a record of the same in appropriate books.
(5) Perform such other duties as the Board may direct.
A. The position of Inspector of Alcoholic Beverage Licenses,
as heretofore created, is hereby continued.
B. The Inspector of Alcoholic Beverage licenses shall:
(1) Make a personal inspection of each licensed premises
for which an application for a transfer has been made.
(2) Report any violation of city ordinances and any rules
and regulations adopted by the Board governing the conduct of licensed premises
which his inspection may disclose.
(3) Perform such other duties as may from time to time be
assigned to him by the Board.
