All appointments to the Fire Division shall be made by the Fire Director from a list prepared by the Civil Service Commission of the state after competitive examination and with special reference to the fitness of the candidates. Before any permanent appointments are made, the candidates shall submit themselves to such examination as may be required by the State Civil Service Commission.
A. 
To be eligible for appointment to the Fire Division, a candidate shall:
(1) 
Be a citizen of the United States.
(2) 
Be of good moral character.
(3) 
Have a high school diploma or an equivalency certificate and be able to read and write the English language well and intelligently.
(4) 
Be sound in mind and body.
(5) 
Be of good health sufficient to satisfy the Board of Trustees of the Police and Firemen's Retirement System of New Jersey that such person is eligible to membership in the retirement system.
(6) 
Not have been convicted of an indictable offense, nor convicted of any crime or offense involving moral turpitude.

The candidate shall obtain a certificate from the Fire Examining Board as provided in § 39-8.
A. 
It shall be the duty of the Fire Examining Board, consisting of the City Physician and the Assistant City Physician, to examine carefully the educational, mental, moral and physical fitness of any person who may be a candidate for appointment to the Fire Division and who may be recommended for such examination by the Fire Director, provided that such candidate has been first certified for appointment by the State Civil Service Commission.
B. 
A certificate, signed by the Fire Examining Board and attesting to the educational, mental, moral and physical capacity of the candidate to discharge the duties of the position to which he is seeking appointment and for which he has been certified, shall be considered and taken by the Fire Director as sufficient evidence of such examination.
Upon appointment to the Fire Division, each candidate, before being sworn into office, shall make an affidavit, under oath, that he has truthfully answered all questions of the State Civil Service Commission and the Fire Examining Board.
Each member of the uniformed Fire Division shall be required to wear a uniform in the performance of his duties.
