This chapter is to be liberally construed to effectuate the purposes
herein described. Nothing herein is to be construed as repealing or abridging
the emergency powers of any agency of government except to the extent expressly
set forth herein.
The Health Officer of the Health Division shall, in addition
to his other duties, enforce and administer the provisions of this chapter
and, in exercising his powers and duties hereunder, shall be known as the
"Director of Air Pollution Control."
The Director may appoint or designate other employees
or officers of the Health Division to perform duties necessary for the enforcement
of this chapter.
Any person who violates any of the provisions of this
chapter or who shall fail to comply therewith or with any of the requirements
thereof shall, upon conviction thereof, be punished by a fine not exceeding
two thousand five hundred dollars ($2,500.) or by imprisonment for a term
not exceeding ninety (90) days or by a period of community service for not
more than ninety (90) days, or any combination thereof. A separate offense
shall be deemed committed on each day during or on which a violation occurs
or continues.[1]
The violation of any section of this chapter shall constitute
a separate and distinct offense independent of the violation of any other
section or of any order issued pursuant to this chapter.
