A. 
It shall be unlawful for any person to keep, maintain or have in his or her possession or under his or her control within the City limits of the City any poisonous reptile or any other dangerous or carnivorous wild animal or reptile, any vicious or dangerous domesticated animal or any other animal or reptile of wild, vicious or dangerous propensities.
B. 
It shall be unlawful for any person to keep, maintain or have in his or her possession or under his or her control within the City limits of the City of Paterson any of the following animals: all poisonous animals, including rear-fanged snakes; apes; chimpanzees; gibbons: gorillas; orangutans; siamangs; baboons; bears; bison; cheetahs; crocodilians 30 inches or more in length; coyotes; deer; elephants; gamecocks and other fighting birds; hippopotamuses; hyenas; jaguars; leopards; lions; lynx; monkeys; ostriches; piranha fish; pumas, also known as "cougars," "mountain lions" and "panthers"; rhinoceroses; sharks; snow leopards; swine; tigers; wolves; horses; cows; goats; turkeys; sheep; pigs; steers; bulls; donkeys; burros; ponies and any other members of the bovine or equine animal families. This section shall not apply to any horse or pony maintained or kept within the City of Paterson prior to May 1, 1984. A person who maintained or kept a pony prior to May 1, 1984, may subsequently maintain or keep a new pony or ponies, provided that the number of ponies under his or her control when this subsection was enacted does not increase.

C. 
It shall be unlawful for any person to keep, maintain or have in his or her possession or under his or her control in the public areas of the City of Paterson any snake unless the same is in a secure approved carrier for the same. This section is intended to apply to those snakes whose possession is not entirely prohibited pursuant to Subsections A and B above. Snakes whose possession is not prohibited pursuant to Subsections A and B above may be maintained within the dwelling unit of the owner of said snake. For the purposes of this section, a public area of the City of Paterson shall be deemed to include, but not be limited to, streets, sidewalks, public parks, public buildings or any retail, industrial or commercial establishment which is open on a regular basis to members of the public.

D. 
The provisions of Subsections A and B shall not apply to licensed permitted uses such as pet shops, menageries, zoological gardens and circuses if:
(1) 
Their location conforms to the provisions of the Zoning and Land Development Ordinance of the City.[2]

(2) 
All animals and animal quarters are kept in a clean and sanitary condition and are so maintained as to eliminate objectionable odors.
(3) 
The animals are maintained in quarters so constructed as to prevent their escape.

Any person who violates any provision of this article shall, upon conviction thereof, be punished by a fine not exceeding $1,000 or by imprisonment for a term not exceeding 90 days or by a period of community service for not more than 90 days, or any combination thereof. A separate offense shall be deemed committed on each day during or on which a violation occurs or continues.
