No license shall be issued under this article unless the applicant for
the license shall establish to the satisfaction of the Health Division of
the City that:
A. The building and the licensed business to be conducted therein conforms and will conform to the requirements of §
417-3 of this article.
B. The premises for which the license is sought is not within 50 feet of a building used in whole or in part as a dwelling. For purposes of this Subsection
B, said distance shall be ascertained by measuring from the nearest point of the premises to be covered by the license to the nearest point of the building used as a dwelling.
All buildings or places in which the slaughtering of poultry or the
sale of live poultry is conducted as a business in the City shall conform
to the following requirements:
A. The building shall be used for the keeping, slaughtering
and selling of poultry only.
B. Such business shall be conducted on the ground floor
only.
C. The floors of each building shall be paved with material
impervious to moisture and shall be properly sloped to a well-trapped inlet
having direct connection with a sewer. The walls of the room in which slaughtering
is actually carried on shall be covered to a height of six feet with smooth,
moistureproof material, and the remainder of the walls and ceilings shall
be finished with a smooth hard surface.
D. Plucking shall not be carried on in a room used for slaughtering.
Watertight receptacles shall be provided for all refuse and shall be properly
covered and removed daily.
E. All rooms or space used for the purpose of slaughtering
poultry shall be ventilated directly to the open air. No such ventilation
shall in any way enter a ventilating shaft which is used in connection with
the living apartments of any building.
F. All coops shall be made of heavy wire and of uniform
size. All stands or counters shall be built substantially and covered with
marble, slate, zinc or tin. Stands, counters and coops shall be raised from
the floor in such a way as to permit flushing underneath the same. A plentiful
supply of water shall be provided. Stands and counters for the sale of poultry
shall be arranged to allow a clear passageway to the public.
G. All parts of such poultry slaughterhouses shall be at
all times kept in a sanitary condition.

Any person who violates any provision of this article shall, upon conviction
thereof, be punished by a fine not exceeding $1,000, by imprisonment for a
term not exceeding 90 days or by a period of community service for not more
than 90 days, or any combination thereof. A separate offense shall be deemed
committed on each day during or on which a violation occurs or continues.
