The office of Township Manager is hereby created
by the Township of Upper Allen, subject to the right of the Board
of Commissioners of Upper Allen Township to abolish said office at
any time by ordinance.

The Manager shall be appointed biannually by
a majority of all the members of the Board of Commissioners of Upper
Allen Township. Said office shall be filled biannually thereafter.
In the event of a vacancy, the Board of Commissioners shall elect
a replacement by majority vote of all of its members for the unexpired
term. The Manager may be removed at any time by a majority vote of
all the members of the Board of Commissioners. At least thirty days
before such removal becomes effective, the Board of Commissioners
shall furnish the Manager with a written statement setting forth its
intention to remove him/her and the reasons therefor.

The Manager shall be chosen solely on the basis
of his/her executive and administrative abilities, with special reference
to his/her actual experience in or his/her knowledge of accepted practices
in respect to the duties of his/her office as herein outlined. The
Manager need not be a resident of the Township or of the Commonwealth
of Pennsylvania at the time of his/her appointment. No Commissioner
shall be appointed as Township Manager during the term for which he/she
shall have been elected, nor within one year after the expiration
of his/her term.

Upon entering his/her duties, the Manager shall
give a bond to the Township with a bonding company as surety, said
company and amount to be approved by the Board of Commissioners, conditioned
for the faithful performance of his/her duties. The premium shall
be paid by the Township. The bond of the Township Manager may be included
in and covered by any comprehensive bond now or hereafter in force
or effect for all Township employees.

The salary of the Township Manager shall be
fixed yearly by the Board of Commissioners as an item of the Upper
Allen Township annual budget.
Neither the Board of Commissioners of Upper
Allen Township nor any of its committees or members thereof shall
dictate or attempt to dictate the hiring of any person to or his/her
discharge from employment by the Manager or in any manner take part
in the hiring, suspending or discharging of employees in the administrative
service of the Township except as required to do so by the civil service
provisions of the First Class Township Code. Except for the purpose of inquiry, the Board of Commissioners, its committees and its members shall deal with the administrative service solely through the Township Manager and neither the Board of Commissioners nor any of its committees nor any of its members shall give orders, publicly or privately, to any subordinates of the Manager. Notwithstanding anything herein contained to the contrary, the Board of Commissioners reserves unto itself the rights, power and authority as set forth in §
44-6.
If the Manager becomes ill or needs to be absent
from the Township, he/she shall designate one qualified member of
his/her staff to perform the duties of the Manager during his absence
or disability. The person so designated shall not perform these duties
for a period longer than two weeks without the approval of the Board
of Commissioners of Upper Allen Township.
