It shall be unlawful for any person, firm or corporation to sell any commodity by means of vending such commodity from a vehicle upon any street in the City of Crystal Lake, unless a license for such vehicle is first secured from the Chief of Police or his/her designated representative. The license shall be for a one-year period, commencing on June 1 and ending on May 31 of the succeeding year, for each vehicle used in street vending. The annual fee for such licenses shall be $50 for each vehicle and shall be paid to the Director of Finance at the time the application is made.
A. 
Application for a license pursuant to the provisions of this article shall be made on a form provided by the Chief of Police or his/her designated representative. The applicant shall truthfully state in full the information requested on the application, as follows:
(1) 
Name and address of present place of residence, business address if other than present residence address, and social security number.
(2) 
Name and address of the person, firm or corporation whom the applicant is employed by or represents.
(3) 
Description of the motor vehicle to be operated under the proposed license, including the engine and license numbers of such vehicle.
(4) 
Names and addresses of not less than two references as to the moral character, honesty and integrity of the applicant.
(5) 
Statement that the applicant will comply with all applicable ordinances of the City of Crystal Lake while operating under such license.
(6) 
Whether the applicant has ever been convicted of the commission of a felony under the laws of the State of Illinois, or any other state or federal law.
B. 
All statements made by the applicant upon the application or in connection therewith shall be under oath.
No such license shall be issued to or held by any person who is not a person of good character or who has been convicted of a felony; nor shall such license be issued to or held by any firm or corporation if any managing agent or officer thereof would be ineligible for a license under the foregoing conditions.
A. 
If the applicant is found to be fully qualified as provided herein, the Chief of Police or his/her designated representative shall issue a license pursuant to the provisions of this article, upon payment of the fee therefor. Such license shall remain in the possession of the licensee at all times while engaged in vehicular street vending in the City of Crystal Lake.
B. 
The Chief of Police or his/her designated representative shall revoke any license issued hereunder if the holder thereof is convicted of a violation of this article, or of any applicable ordinance of the City of Crystal Lake. Such license shall also be revoked if the holder thereof has made a false material statement in the application or otherwise becomes disqualified for the issuance of a license under the terms of this article.
The following rules and regulations shall be complied with by each person using a vehicle for street vending in the City of Crystal Lake:
A. 
It shall be unlawful for any vehicular street vendor to sell or attempt to sell any commodity:
(1) 
By means of any outcry or sound in excess of the levels provided in Chapter 358, Noise, of the Code of Ordinances of the City of Crystal Lake, or to make such outcry or sound when passing a hospital or a church or other place of worship during the hours when services are being held.
(2) 
Within 500 feet of any school during the school year.
B. 
The use by any such vendor of any loud outcry or sound shall be prohibited before the hours of 9:00 a.m. on weekdays and 10:00 a.m. on Sundays, or after 7:00 p.m. on any day.
C. 
It shall be unlawful for any such vendor to:
(1) 
Exceed a speed of 12 miles an hour when cruising neighborhoods seeking sales or when attempting to make a sale.
(2) 
Make more than two stops in any one block to make any sale.
(3) 
Double park or park in any manner contrary to any ordinance of the City of Crystal Lake relating to parking when attempting a sale or when making a sale.
(4) 
Make a U-turn on any block.
(5) 
Drive the vehicle backwards to make or attempt any sale.
(6) 
Sell to any person who is standing in the street.
(7) 
Permit any person to hang on the vehicle or permit any person to ride in the vehicle except a bona fide assistant or assistants.
(8) 
Remain standing or stopped at any place for a period of time exceeding 10 minutes.
(9) 
Sell or attempt to sell along any particular route more than one time within a twenty-four-hour period.
D. 
Each vehicular street vendor must comply with all applicable ordinances of the City of Crystal Lake relating to traffic control[1] or the public health, safety or morals.

Any person, firm or corporation violating the provisions of this article may, in addition to any penalty imposed under Chapter 248, Fines, of this Code, suffer the penalty of having his/her or its license revoked for any such violation. Revocation shall be in writing signed by the Mayor.[1]
