Such sections read as follows: “SECTION 1. Legislative findings. The
Town Board of the Town of Southampton hereby finds that it is within its property,
affairs and government to ensure the proper care of stray or unwanted animals
maintained within animal shelters in the Town of Southampton. The unrestricted
and unregulated keeping of animals within the animal shelters poses a potential
threat to the health, safety and welfare of its citizens. Improper care of
animals within animal shelters may result in the spread of communicable diseases
from said animals to other animals and to humans. In addition, the Town wishes
to ensure that the state policy of protecting against cruelty to animals and
ensuring humane treatment of animals is fully implemented in the Town. It
is the purpose of this local law to protect the health, safety and welfare
of its citizens from the dangers associated with the unrestricted keeping
of animals and to promote the humane care of animals. SECTION 3. Applicability
to existing animal shelters. All lawfully existing animal shelters in operation
on the effective date of this local law shall have 180 days from said effective
date to obtain the permit and meet the standard provided for in this local
law. The Town Board may waive any standard provided for in § 17-8
relating to facility standards in considering a permit application for an
existing facility where it determines that the standard would impose an unnecessary
hardship.”
