Except as hereinafter provided, no person shall at any time set or use
a trap of any kind designed or intended to take hold of, capture or kill any
bird or animal within the limits of the Township of Colts Neck.
This chapter shall not prohibit owners or tenants of any property within
the Township of Colts Neck from trapping, by any means, birds or animals located
within any building located on the property of which he or she is the owner
or tenant.
Traps, as authorized by the State of New Jersey, may be set not less
than 500 feet from the nearest residential dwelling by persons licensed by
appropriate authorities of the State of New Jersey to capture or kill animals
which, as a class, threaten, destroy or damage growing crops. Within 500 feet
of residences, only owners, tenants or those persons who have secured expressed
written permission from the owner may trap birds or animals only by means
of a cage-type trap, commonly called "cage-trap," "cage-door trap" or "live
trap," each of which is designed to capture animals alive. The owner of the
premises in question shall be deemed to be that person appearing on the latest
tax duplicate list maintained by the Assessor of the Township of Colts Neck.
Whenever a trap is used contrary to the provisions of this chapter within
the confines of the Township of Colts Neck, the same may be confiscated by
any duly authorized police officer or by any New Jersey Fish and Game Warden.

A violation of any provision of this chapter shall be punishable as provided in §
1-9 of this Code.
