As used in this chapter, the following terms
shall have the meanings indicated:
DRIVEWAY
In addition to its regularly accepted common meaning, shall
also mean any lane, way, field entrance or privately owned road. A
driveway is "modified" within the meaning of this chapter when it
is paved, widened or narrowed or when its location or grade is changed.
No driveway which intersects with the right-of-way
line of any public road within the Township of Readington may be constructed
or modified unless the owner of the land upon which the driveway is
to be constructed or modified first obtains a driveway permit from
the Readington Township Road Supervisor. The applicant shall, prior
to the issuance of the permit, pay a fee of $25 to the township.
All driveways which intersect with the right-of-way
line of any public road within the Township of Readington and which
are to be constructed subsequent to the effective date of this chapter
and all such driveways existing as of the effective date of this chapter
and which are modified subsequent to the effective date of this chapter
shall be constructed in accordance with the following minimum requirements:
A. The driveways shall be constructed so as to slope
from the point of intersection of the road right-of-way line and the
center line of the driveway toward the edge of the traveled way of
the public road so that the finished grade of the driveway at a point
25 feet from the center line of the traveled way of the public road
shall be no more than six inches higher than the center-line elevation
of the traveled way of the public road.
B. The driveways shall be constructed so as to be perpendicular
to the traveled way of the public road for a distance of at least
25 feet from the center line of the traveled way and shall intersect
the traveled way at the perpendicular.
C. The driveways shall have a minimum driving width of
10 feet, with a minimum radius of five feet on each side as they touch
the traveled way of the public road.
All driveways, including those constructed subsequent
to the effective date of this chapter and those existing prior to
the effective date of this chapter, shall be constructed and maintained
at all times by the owner of the land upon which they are located
in such a manner as to prevent the discharge of water from the driveway
onto the public road, the erosion of soil from the driveways and the
land behind them and the obstruction of or interference with drainage
within the right-of-way.
No driveway constructed subsequent to the effective
date of this chapter and no driveway existing prior to the effective
date of this chapter which is modified subsequent to the effective
date of this chapter shall be allowed to extend beyond the edge of
the existing ditch lines of the traveled way of the public road at
an elevation creating a hump or uneven driving surface on the traveled
way or shoulder.
The construction of a properly sized dish-type
gutter will be permitted, provided that the existing township water
flow will not be blocked, altered or changed in any manner.
The installation of suitable reinforced concrete
pipe or culvert will be required in the event that the existing flow
line or ditch cannot be crossed with a shallow dish-type gutter. The
size of the pipe or culvert required shall be determined by the Readington
Township Road Supervisor pursuant to acceptable engineering practice.
All driveways constructed subsequent to the
effective date of this chapter and all driveways existing prior to
the effective date of this chapter which are modified subsequent to
the effective date of this chapter shall, for a distance of 25 feet
from the center line of the traveled way, be constructed as follows:
A. Driveways entering unpaved roads: four inches (compacted
thickness) of one-and-one-half-inch quarry-processed (blend) stone
thoroughly rolled and compacted at the specified width.
B. Driveways entering paved roads:

(1) Subbase course: four inches (compacted thickness)
of one-and-one-half-inch quarry-processed (blend) stone thoroughly
rolled and compacted.
(2) Base course: five inches (compacted thickness) of
bituminous concrete, hot-mix asphalt Type 19M64.
(3) Surface
course: two inches (compacted thickness) of bituminous concrete, hot-mix
asphalt Type 9.5M64.
C. All materials shall comply with the New Jersey State
Specifications for Road and Bridge Construction, 2007 Edition, and
all amendments and revisions thereto.

The person or persons, firm or corporation applying
for a driveway permit shall submit a plan in sufficient detail to
the Road Supervisor for his approval prior to the issuance of said
permit. The plan shall show or include the following information:
A. A plot or site plan showing the driveway for its entire
length and its relation to the public road.
B. A profile of the driveway showing existing and proposed
center-line grades and elevation for its entire length.
C. A plan showing the type of storm drainage to be constructed
at the driveway entrance to the township road, i.e., dish-type gutter,
pipe, gutter or culvert. Sizes of pipes, culverts and gutters, grades,
elevations, typical cross sections, construction details and any other
information deemed necessary to the proper analysis of the installation
shall also be shown.

No building permit shall be issued by the Code Enforcement Officer for the construction or alteration of any structure where inherent in any application for such permit a driveway permit is required in accordance with the terms of this chapter until said driveway permit and all works required thereby shall be completed, except that the improvement required by §
106-8 may be completed at any time prior to the issuance of the certificate of occupancy. No certificate of occupancy is to be issued prior to the completion of all the requirements of this chapter as certified to the Code Enforcement Officer by the Road Supervisor.
Any person or persons, firm or corporation violating
any provision of this chapter which results in damage to or obstruction
of any township road, gutter, storm drain, ditch, basin, inlet or
culvert shall be responsible for all expenses incurred by the Township
of Readington in repairing said damage or removing said obstruction,
in addition to the penalty herein provided.

Any person or persons, firm or corporation violating
any of the provisions of this chapter shall, upon conviction thereof,
be subject to a fine not exceeding $1,000, imprisonment for a period
not exceeding 90 days and/or a period of community service not exceeding
90 days. Each and every day that said violation continues shall constitute
a separate and specific violation.
