The following rules of construction of language shall apply to the rest
of this chapter:
A. Words used in the present tense include the future tense.
B. Words used in the singular include the plural, and words
used in the plural include the singular.
C. The word "person" includes an individual, firm or corporation.
D. The word "shall" is always mandatory.
For the purposes of this chapter, certain terms or words used herein
shall be interpreted or defined as follows:
ACCESSORY BUILDING
A building customarily incidental and subordinate to the principal
building and, except as otherwise provided, located on the same lot with such
principal building.
BUILDING
A combination of any materials, whether portable or fixed, having
a roof, to form a structure affording shelter for persons, animals or property.
DEDICATION
An appropriation of land to a public use, made by the owner and accepted
for such use by or on behalf of the public.
DEVELOPER
Any individual, firm, company, association, society, corporation
or group that constructs or erects or proposes to construct or erect structures
or other improvements on a parcel of land.
DRAINAGE SYSTEM
A ditch, channel, creek, waterway, culvert, pipe, conduit, stormwater
detention facility or related structure which carries or stores or is proposed
to carry or store storm- and surface water and runoff, but, in compliance
with the requirements of Public Law 92-500 excludes sewage and industrial
wastes other than unpolluted cooling water.
EASEMENT
A right-of-way granted for the limited use of private lands for a
public purpose.
FINAL PLAT
A drawing or drawings, complete and in final form, showing all details
required by law and by ordinances, requirements and regulations of the Town
of Cheektowaga, to be submitted to the Town Planning Board for review and
recommendations and which, if approved by the Town Board of the Town of Cheektowaga,
shall be filed in the Erie County Clerk's office.
LOT
A parcel of land occupied or capable of being occupied by a principal
building or use or a group of principal buildings or uses that are united
by a common interest or customary accessory building or uses and including
such open spaces to be used in connection with such building or uses. A lot
may or may not be a lot of record.
LOT LINES
The property lines bounding the lot. Where any property line parallels
a street and is not coincident with the street line, the street line shall
be construed as the property line for the purpose of complying with the regulations
of this chapter.
MAJOR NATURAL WATERWAY
A creek or channel which can be located on aerial photographs or
maps prepared from such photographs, is shown on United States Geological
Survey Maps and has a tributary area greater than 400 acres.
OFFICIAL MAP
A map established and adopted by the Town Board of the Town of Cheektowaga
under § 270 of the Town Law and for the purposes set forth in this
chapter.
OFFSET
The least horizontal distance from any existing or proposed building
or structure to the nearest point in an indicated boundary or property line
of an easement or right-of-way.
PERSON
Any individual, firm, company, association, society, corporation
or group.
SITE PLAN
A map or plan showing the proposed development of an area. It shall
be drawn to a scale of not less than one inch equals 50 feet and shall include
details outlined in the Zoning Ordinance of the Town of Cheektowaga, New York.
STRUCTURE
Anything constructed or erected which requires permanent location
on the ground or attachment to something having such location, but not including
a trailer.
SUBDIVIDER
The authorized representative or agent of the owner of a subdivision,
or the owner of a subdivision.
SUBDIVISION
The partitioning or division of a parcel of land into two or more
lots, sections or sites along an existing or proposed street, highway, easement
or right-of-way for sale or for rent as building lots, regardless of whether
the lots to be sold or offered for sale or leased are described by metes and
bounds or by reference to a map or survey of the property or by any other
method of description. The term "subdivision" includes resubdivision of land
but does not include the sale or exchange of land between adjoining property
owners where such sale or exchange of land does not result in the creation
of additional building lots.
TOWN ENGINEER
The Town Engineer of the Town of Cheektowaga, New York.
TRAILER
A vehicle used for living or sleeping purposes and standing on wheels
so that it can be moved readily.
