No person may offer for sale a lot that was not defined as a
separate parcel of land on the Tax Map of the Village of Pelham on
April 1, 2016, without first obtaining the approval of the Board of
Trustees for a subdivision plat in the manner provided by Article
7 of the Village Law. No permit for the construction of any building
on any lot in a proposed subdivision may be issued unless the subdivision
has been duly approved by the Board of Trustees, the plat has been
duly filed in the office of the County Clerk and the street or highway
giving access to the lot has been suitably improved to the satisfaction
of the Board of Trustees or a performance bond as required by the
Board of Trustees has been duly filed with the Board of Trustees.
The owner or lessee of any building, structure
or use that does not conform to the provisions of this chapter but
that did conform with the applicable zoning regulations of the Village
of Pelham, the Village of Pelham Heights or the Village of North Pelham
at the time when it was first established or at any time thereafter
may apply to the Building Committee for a certificate of legal nonconformity.
The application shall contain proof of prior compliance and shall
state in detail the precise nature of the present nonconformity of
all or any part of the building, structure or use, including the extent
of the floor or land area, as the case may be, and the location within
the building or on the lot which is occupied by any nonconforming
use.
