Parking meter zones shall be established and parking meters installed at suitable locations as described in § 163-66, Schedule XIII, Parking Meter Locations. The Borough Council may designate by ordinance other areas for inclusion in the parking meter program, or modify parking meter fees.
A. 
The Police Department shall locate parking meters at locations with approval of the Public Safety Committee or its successor and confirmation by ordinance of Council.

B. 
The meters shall be placed immediately adjacent to each designated parking space. The proper parking of a car at each meter shall be indicated by lines painted on the surface of the street, which will be renewed from time to time as required.
C. 
Each parking meter shall indicate by a proper legend the established legal parking time, parking fee, and maximum parking time duration. Each meter shall indicate on its display the duration of legal parking time or any illegal or overtime parking.
A. 
The deposit of the proper amount of legal U.S. coins into a meter for the indicated time shall be effective between the hours of 8:00 a.m. to 5:00 p.m., Monday through Friday. All other hours and Saturdays, Sundays and legal holidays [as defined in § 163-1B, the term "legal holidays," as used in this chapter, shall mean and include New Year's Day, President's Day, Good Friday, Memorial Day, Independence Day, Labor Day, Armistice Day (Veterans Day), Thanksgiving Day and Christmas Day], shall be exempt from the coin deposit requirements of parking meters, excepting the Howard Elmer Parking Meter Zone described in Subsection B below.
B. 
No parking between the hours of 12:00 a.m. and 9:00 a.m. for every day of the week, including Saturdays, Sundays, and legal holidays is in effect for the parking meter zones abutting Howard Elmer Park.
A. 
The operator shall, upon parking any vehicle in any parking meter space, immediately deposit in the meter controlling such space the proper coin of the United States as designated for such parking on in accordance with instructions appearing upon the meter. Upon deposit of such coin and placing the meter in operation, any vehicle may lawfully occupy such meter space during the period indicated on the meter.
B. 
No person shall knowingly deposit or cause to be deposited in any meter counterfeit slug, device, or metallic substitute for legal coins of the United States.
A. 
No person shall deface, injure, tamper with, or willfully break, remove, destroy, or impair the usefulness of any parking meter.
B. 
No parking meter shall be used for posting of advertising material.
C. 
Any person found in violation of this section shall be fined $50 and shall be required to pay for the repair, or replacement cost, and installation of each meter.
While vehicles are engaged in loading or unloading with reasonable promptness, the operator shall not be required to deposit any coin in the parking meter for the use of the reserved space.
A. 
A parking meter may be rented by an individual or an organization for various activities or events. The Council, Mayor, or Chief of Police shall approve the event prior to meter bags being issued. The party receiving the meter bag or bags shall tell the location of said meters and the number of days said meter shall be bagged, not to exceed 30 days.
B. 
Cost for the meter bag is $5 for every day the meter is to be bagged. A deposit fee of $10 may be requested, and if the bag or bags are damaged, there will be no refund, if previously paid. A replacement fee of $10 per damaged bag will be charged. Said money shall be used to replace damaged bags. Rental fees may be adjusted as necessary through a resolution of Council.
C. 
A contractor may rent a parking meter for purposes of construction or maintenance at a building site adjacent to Borough parking meters, if the following conditions are met:
(1) 
The contractor has a valid building permit for the previously mentioned construction site or the building site.
(2) 
The contractor has obtained the permission from the Chief of Police.
(3) 
The contractor has paid in advance the sum of $5 for every day the meter is to be bagged.
(4) 
The contractor may not rent said meter at the same location for more than 30 consecutive days without the written approval of Council.
(5) 
The contractor shall pay a daily deposit fee of $10 for the rental of a meter bag to the Sayre Borough Secretary. The deposit of $10 shall only be refunded when the parking bag is returned. If the bag is damaged there will be no refund.
(6) 
If any individual places any bag or other covering over a parking meter and is not authorized to do so as set forth herein, the violator shall pay a fine of $20 for each meter bagged, and each day said violation occurs shall be treated as a separate offense.
D. 
Special events parking.
(1) 
Upon written application to the Police Chief or his designee, permission may be obtained for special event permits to be used for limited hours during special events. Such applications must identify the purpose of the event, the date and times, the number of vehicles expected and the name of the responsible person to contact with respect to said event. These meter bags will be issued only to the responsible person and will be valid for no longer than 24 hours. The meter bags may be free for said special event.
(2) 
The Police Chief or his designee shall grant such number of meter bags as he shall deem appropriate, after consideration of the health, safety, and welfare of the residents of the surrounding community, residents of the meter parking program and the purposes of the meter parking program. When such permission is granted, the Police Chief or his designee shall notify the applicant and the Sayre Police Department.
A. 
A vehicle occupying a metered space beyond the time limit set forth on the parking meter controlling said space shall be considered in violation of this article. The parking meter shall indicate the violation by proper sign upon its display.
B. 
Any violator receiving a second or subsequent ticket is again a violator if the prior violation is not corrected within two hours of the issuance of the prior ticket. Those tickets occurring after the original offense will be considered as an additional violation and the fine will be double the amount of the first violation. The offender shall be required to pay a fine for the original ticket and any further penalties for each additional ticket.
C. 
The following fines are assigned to the listed offense. Fines for second and subsequent offenses will be doubled if not corrected within a two-hour period starting with the issuance of the first ticket:

D. 
The fines listed in table in Subsection C above shall be the minimum fine for the marked violation if paid within 48 hours after issuance of the ticket. If not paid within that time, Sayre Borough under Code § 163-26B, Towing and wheel boot policy, may boot the vehicle and charge an additional $100 booting fee, $150 towing fee, and a $50 per-day storage fee. Thereafter, the minimum fine shall be doubled for each marked violation if paid after this forty-eight-hour period and within 30 days of the issuance of the ticket. After this time, a citation may be issued, with the citation including costs being the costs being charged by the District Magistrate's office for said violation.
E. 
Should the person to whom the ticket for the violation has been issued fail to pay or cause not to be paid the penalty and costs as aforesaid, then and in that event a citations summons may be issued before the District Justice of said Borough, and, should the offender be found guilty, he will be sentenced to pay the fine of $10 for a parking meter violation, $40 for unauthorized use of meter bag, use of counterfeit slug $10, deface, injure, tamper with, or willfully break, remove, destroy, or impair the usefulness of any parking meter $50, negligently deface, injure, tamper with, or willfully break, remove, destroy, or impair the usefulness of any parking meter $100 to $600, and $25 for a twenty-four-hour period for parking during a snow emergency; in addition, the cost of repairs replacement, and installation of any damaged parking meter. The court costs will be for only one violation; however, the fines will be assessed for each violation occurring on the same date.
F. 
Fines designated in the foregoing subsections of this section are to be considered in addition to whatever other fines may be imposed by operation of the law.
A. 
The Borough Council or the Public Safety Committee or their successor until the Council has acted shall designate an officer of the Borough or some other suitable person whose duty it shall be to periodically collect the boxes from the parking meters and deliver them to the designated depository bank of the Borough of Sayre, with the seals unbroken.
B. 
Said bank shall cause the money to be counted and placed to the credit of the Borough Treasurer in a special fund to be known as the "Meter Fund" and shall report to the Borough Council once a month, or as required, the amount so received. The Meter Fund shall be used as directed by the Council. The compensation for such services shall be fixed by the Borough Council in agreement with the bank.
The Council, by resolution, shall enter a contract to purchase and install meters, and the President and Secretary of the Council are hereby authorized to execute an acceptance thereof and attach the Borough Seal thereto on behalf of the Borough of Sayre.
Nothing herein contained nor in any ordinance hereafter establishing parking meter zones shall be construed to permit parking of vehicles in those spaces within any zone in which by other ordinances of the Borough parking is prohibited. Until meters are installed in the parking meter zones hereinafter described, the parking of vehicles in said zones shall be limited to the time and manner fixed by existing ordinances.
