The purpose of this chapter is to further the preservation, rehabilitation
and reuse of historic resources, to promote the cultural, economic, social,
and general welfare of the Town, and to improve property values in old districts.
It is the specific intent of this chapter to provide adequate time for all
parties to consider and put forth appropriate alternatives to the demolition
of such resources, where they are not otherwise protected.
In addition to all of the requirements established by the State Building
Code and the General Statutes, no permit for the demolition of any building
or part thereof which is 500 total square feet in size or larger, and more
than 50 years old, shall be issued until the following requirements are satisfied:
A. Filing by the applicant of written verification of the
age of the building with the Building Official.
B. Publication by the Building Official of notice of the
demolition permit application in a newspaper having substantial circulation
in the Town. The notice shall be published once within five working days following
the filing of the demolition permit application and shall state the following:
that an application has been filed for a demolition permit; the date of the
filing of such application; the location of the property; the name of the
owner of the property; that unless written objection is filed with the Building
Official within 15 working days following publication of the notice, the permit
may be issued after the expiration of such fifteen-working-day period; and
that if written withdrawal of any objection is filed with the Building Official,
the permit may be issued forthwith.
C. Notification by mail by the Building Official within five working days following the filing of the demolition permit application of such pending application. Such notification shall contain the same statement as required by Subsection
B of this section and shall be directed to the Cheney Brothers National Historic District Commission, to the Manchester Historical Society and to any other persons or entities who shall register with the Building Official as herein provided. This chapter shall not relieve the applicant of the obligation of giving notice to any other persons or entities as otherwise required by law.
D. The expiration of a period of 90 days from the date of the application, provided that, if no objection, as herein provided, is received by the Building Official within 15 working days of the publication and of the mailing of notice as provided in Subsections
B and
C herein, or if any objection, as herein provided, is withdrawn, and such withdrawal is received by the Building Official, the Building Official may issue the permit forthwith.
All objections to any application covered by this chapter shall be in
writing and shall be delivered or mailed to the Building Official, the owner
of the building and to the applicant. All withdrawals of objections shall,
similarly, be in writing and shall be delivered or mailed to the Building
Official, the owner of the building and to the applicant.
In order to be entitled to notice by mail as provided by §
133-2C of this chapter, each person or entity, other than the Cheney Brothers National Historic District Commission and the Manchester Historical Society, shall register at any time after the effective date of this chapter, and annually thereafter, with the Building Official, and shall pay an annual registration fee on March 1 of each year, in an amount to be established by regulations of the Building Official, approved by the Board of Directors.
In the case of any unsafe building or structure, the Building Official
may take emergency measures as prescribed by the State Building Code or the
General Statutes.
