In order to minimize erosion of banks along the Lewes-Rehoboth Canal within the Town of Henlopen Acres and to provide adequate safety regulations for boats operating within the Town limits, this chapter adopts those parts of Amendment 7 of House Bill 510 as passed by the 1973-1974 Session of the Delaware Assembly (Delaware Code, Title 23, Chapter 22, Subchapter 2) and subsequent regulations adopted by the Division of Fish and Wildlife of the Department of Natural Resources and Environmental Control, which pertains to speeds of boats such that no wake is created or a maximum speed of four miles per hour is maintained, whichever is less.
In order to notify the boat operators of this chapter, the Town of Henlopen Acres shall erect signs along the Canal stating that such laws of the State of Delaware and applicable regulations have been adopted by this chapter and that any observed violations shall be reported to the Marine Police of the State of Delaware for action under their regulations for no-wake operation of boats within the state.
