As used in this article, the following terms
shall have the meanings indicated:
GARBAGE
Means and Includes all kitchen and table waste of an animal
or vegetable nature, swill, offal, vegetables, fruits, meats, fish,
bones, fat, carrion, market refuse, dead cats and dogs, all putrescible
matter, both solid and liquid, animal and vegetable, which may result
from the preparation of meat, fish, fowl and vegetables of any character
or which may be caused by the decay of foodstuffs or by handling,
storing or dealing in the same.
REFUSE
Means and Includes waste material other than rubbish, ashes,
or garbage, that attends use or decay and accumulation from the occupancy
of buildings or premises.
RUBBISH
Means and Includes solid waste material accumulating or resulting
from the use or occupancy of buildings or premises, such as paper,
straw, excelsior, rags, old clothes, old shoes, and other material
of similar character.
It shall be unlawful for any person to place
or cause or suffer to be placed in receptacles any garbage that is
to be collected and removed by the collector of garbage, unless such
garbage has been thoroughly drained of its moisture and wrapped in
substantial paper, and no substance not included in the word "garbage"
shall be placed in garbage receptacles; the wrapped garbage shall
be placed and stored, awaiting removal or disposal, in metal containers;
such containers shall be covered with tightly fitting metal lids.
No person other than an authorized employee
or agent of the City shall disturb or remove garbage containers or
garbage placed in containers, for collections, unless requested by
the person to whom the container belongs.
No person shall deposit, or cause or suffer
to be deposited garbage in a public or private alley.

It shall be unlawful for any person, other than
the authorized representative of the City, to engage in the business
of collecting or transporting garbage, refuse, rubbish or other waste
materials without first obtaining a Business License Permit from the
New Castle City Public Services Department.
All vehicles transporting garbage, refuse or
rubbish shall be securely built and either enclosed or covered securely
with a tarpaulin so as to prevent the loss of contents during transportation.
No rubbish, refuse or other waste or offensive
materials shall be deposited on any public or private dump or place
in the City except in accordance with the rules and regulations of
the Board.
