The city government, the City Engineer, or their designated
representative, at reasonable hours may enter into and upon any land within
the municipality, either public or private, for the purpose of making any
survey for any public engineering work within the city, including but not
limited to the location of, construction, demolition, improvement or alteration
of any open or unopen streets or roadways, sanitary sewer systems or plants,
water systems or plants, electrical systems or plants, drainage, construction,
lighting service; and rights-of-way, or other property rights required for
any public work or other project of a public nature.
As part of its survey, the city government, the City
Engineer, or their designated representative, may place and maintain necessary
monuments and markers upon the land so entered.
Violation of the provisions of this chapter or failure
to comply with any of its requirements shall constitute a misdemeanor. Any
person who violates this chapter or fails to comply with any of its requirements
shall, upon conviction thereof, be fined not more than $50 or imprisoned for
not more than 30 days, or both, and in addition shall pay all costs and expenses
involved in the case. Each day such violation continues shall be considered
a separate offense.
The owner or tenant of any building, structure, premises,
or part thereof, and any architect, builder, contractor, agent or other person
who commits, participates in, assists in or maintains such violation may each
be found guilty of a separate offense and suffer penalties herein provided.
