Filling and grading — See Ch. 88.
No permit shall be granted and it shall be unlawful for any person to authorize or participate in:
A. 
The removal of sand from the ocean beaches.
B. 
The removal of sand, soil, dirt or earth from any dune, mound, dike or hill adjoining the ocean beaches so as to reduce the height thereof to less than 16 feet above mean sea level (United States Coast and Geodetic Survey datum plane).[1]

Editor's Note: Former Section 11-3.4c and d, which prohibited removal so as to reduce the height of land and removal to a point outside the borough and immediately followed this subsection, were deleted at time of adoption of Code (see Ch. 1, General Provisions, Art. I).
A violation of this chapter shall be punishable as provided in Chapter 1, General Provisions, § 1-15.
