GENERAL REFERENCES

As used in this chapter, the following terms shall have the meanings indicated:
ALARM SYSTEM
The combination of sensory apparatus and other equipment which, when activated by the appropriate stimulus, signals the Police or Fire Department that immediate response and investigation is required.
CALENDAR YEAR
That year which begins on January 1 at 12:00 midnight and ends on December 31 at 11:59 p.m.
FALSE ALARM
The activation of an alarm device not justified by a real emergency. Such terminology does not include alarms caused by hurricanes, tornadoes, earthquakes or other such conditions.
FIRE CHIEF
The Chief of the Volunteer Fire Department of the Borough of Bay Head or a designated representative or, in the absence of a Chief of the Fire Department, the senior ranking member of the Fire Department.
FIRE DEPARTMENT
The Volunteer Fire Department of the Borough of Bay Head.
PERSON
Any person, firm, partnership, association, corporation, company or organization of any kind.
POLICE CHIEF
The Chief of Police of the Borough of Bay Head or a designated representative or, in the absence of a Chief of Police, the senior ranking member of the Police Department.
POLICE DEPARTMENT
The Police Department of the Borough of Bay Head.
POSSESSOR
The owner or lessor of any premises which contain an alarm system.
A. 
Any person possessing an alarm system shall not be charged for the first three (3) false alarms responded to by the Police or Fire Departments within the calendar year, however, for each false alarm after the first three (3) to which the Police or Fire Department responds within a calendar year, there shall be a fine, in an amount as set forth in the Violations Bureau Schedule on file in the borough offices, for each and every separate violation.[1]

B. 
In the event of a fourth or subsequent false alarm, an investigation shall be conducted by the Police or Fire Department. When such investigation discloses continued negligent or abusive operation or maintenance of an alarm system, the Police or Fire Chief may require disconnection of the alarm for a limited or permanent duration. The Police and Fire Chief must provide written notice of such intent to disconnect at least fourteen (14) days prior to disconnection.

Unless otherwise specified herein, for a violation of any provision of this chapter, the maximum penalty, upon conviction thereof, shall be a fine not exceeding one thousand dollars ($1,000.) or imprisonment for up to ninety (90) days or a period of community service not exceeding ninety (90) days, or any combination thereof. Except as otherwise provided, each and every day in which a violation of any provision of this chapter exists shall constitute a separate violation.
B. 
All fines and penalties under this chapter may be paid directly to the Municipal Court Administrator, unless otherwise indicated by the officer issuing the summons.
