The Municipal Clerk is hereby authorized and directed to license, pursuant
to the provisions set forth below, all bona fide organizations and associations
to hold and operate games of chance, commonly known as a "raffle" or "raffles"
as provided for in N.J.S.A. 5:8-50 et seq.
Applications for raffle licenses shall be filed with the Municipal Clerk
in writing and on forms prescribed by the rules and regulations duly adopted
from time to time by the Legalized Games of Chance Control Commission of the
State of New Jersey.
The governing body of Berlin Borough is hereby authorized to make or cause to be made the required investigations of the qualifications of each applicant for such license and the merits of each application for such license, as expeditiously as possible subsequent to the filing of the application. In the event that the governing body determines that the applicant is duly qualified to hold, operate and conduct a raffle or raffles, as set forth herein, the governing body shall so certify by resolution to the Municipal Clerk, who shall issue an appropriate license upon the payment of a license fee as established from time to time by the Raffles Licensing Law referred to in §
173-1 above.
No license issued, as provided herein, shall be effective for a period
longer than one year, and all such licenses shall expire on December 31 of
each year.
Games of chance may be conducted under any license issued pursuant to
the provisions hereof on the first day of the week, commonly known and designated
as "Sunday."
Any person violating any of the provisions of this chapter shall be
imprisoned in the county jail for a period not exceeding 90 days or shall
be subject to a fine not less than $100 nor more than $1,000, or both, or
required to serve a period of community service not exceeding 90 days, in
the discretion of the court, and each day's continuance of the violation shall
constitute a separate and distinct violation.
