No person shall keep, manufacture, prepare,
offer for sale, sell or distribute any food or drink for human use
which has been exposed to any injurious contamination or communicable
disease, or which is unwholesome, impure, decayed, diseased or for
any reason unfit for human consumption, or which has been mislabeled
or adulterated within the meaning of the laws of the State of New
Jersey or of the United States of America.
No owner, proprietor or person in charge of
any store, market, roadstand, restaurant, hotel, lunch counter, fountain
or other place where food or drink for human use is manufactured,
prepared, handled, stored, sold or served shall use the premises for
any of such purposes unless said establishment is properly lighted,
ventilated, drained and kept in a thoroughly clean and sanitary condition
at all times, in accordance with the rules and regulations of the
Board of Health.
No person in any park, playground, hotel, school
or other public place shall furnish or permit any common drinking
cup or utensil to be used.
Every owner, proprietor or person in charge
of any store, roadstand, market, restaurant, hotel, lunch counter,
fountain or other place where food or drink for human use is manufactured,
prepared, handled, stored, sold or served shall require all salesmen,
waiters, workmen and employees to be clean and to wear clean clothing
at all times while working in such establishment or place. No person
who is affected with, or suspected of being affected with, any communicable
disease as defined in this code, or of harboring the causative agent
thereof, shall be permitted to engage in the handling of food in any
such establishment, and shall not resume his occupation until permission
shall have been obtained in writing from the Board of Health. All
such employed persons must wash their hands before starting to work
and after using the toilet.
No person shall maintain any well or other supply
of water used for drinking or household purposes which is polluted
in any manner that may render such water injurious to health or which
is so situated or constructed that it may become so polluted.
No impure ice or ice cut from a polluted pond,
lake or stream, and no ice manufactured from impure water, shall be
used or sold within the Borough.
In case the owner, proprietor or person in charge
of any store, market, roadstand, restaurant, hotel, lunch counter,
fountain or other place where food or drink for human use is manufactured,
prepared, handled, stored, sold or served shall fail to keep such
establishment or place of business in a clean and sanitary condition
after being notified so to do by the Board of Health; or in case such
food or drink, or the sale of the same, be liable to cause any illness
or transmit disease, such establishment or place of business shall
be closed until it first be put in clean and sanitary condition or
until the food or drink, or the sale of the same, shall be no longer
liable to cause any illness or transmit disease. It shall be the duty
of the owner or person in charge of any establishment or place of
business so ordered closed to comply immediately with and obey such
order and to conduct no further operations until permission has been
granted by the Board.
