A. 
A preliminary application for a mobile home park permit must be obtained from and filed with the Town Clerk. A nonrefundable filing fee as determined by the Town Board[1] will be retained by the town.

B. 
A preliminary application must contain:
(1) 
The name and address of the property owner and name and address of the applicant, if different.
(2) 
A legal description of property on which the proposed park will be located, including the book and page reference to the deed recording and the tax map designation of the property.
(3) 
For mobile home parks of two or more lots, a map of the proposed park, drawn by a licensed architect or engineer, must be enclosed with said application and must contain:
(a) 
General layout plan of the proposed park, including the estimated number of lots, lot size locations, recreation areas, accessory buildings and service buildings.
(b) 
Abutting property owners and their existing property use.
(c) 
Proposed access and ingress routes and internal streets.
(d) 
Present and proposed method of sewer and water service and other utility lines.
(e) 
Any unusual special land features such as streams, creeks, areas subject to flooding and areas of steep slopes in excess of 10%.
(4) 
Said application, when completed, filed and fee deposited, shall be submitted to the Town Board at its next scheduled regular meeting.
Said mobile home park permit shall expire on the first of the year following the date of issuance, but may be renewed for an additional period of one year if it can be shown that there has been substantial progress in the construction, alteration and/or extension of said mobile home park.
No mobile home may be installed or located within such park unless it shall comply with all requirements of this chapter and the Uniform Fire Prevention and Building Code and all of the requirements for single-lot mobile homes contained in Article III above except lot size requirements and setbacks therein.
A. 
No mobile home park may be established on a plot or parcel of land less than two acres for one trailer, plus an additional one-half (1/2) acre for each mobile home park lot, up to a total of four lots [three and one-half (31/2) acres].
B. 
Every lot shall meet the following minimum requirements:
(1) 
Lot area per mobile home: the first lot, two acres and, for each lot thereafter, one-half (1/2) acre.
(2) 
Front yard setback from mobile lot line: 20 feet.
(3) 
Side yard setback depth from mobile home lot line: 25 feet.
(4) 
Rear yard setback depth from mobile home lot line: 25 feet.
(5) 
All mobile homes shall be located at the greater of 50 feet from the right-of-way of the road or 75 feet from the center line of any state or public road and no closer than 25 feet from any side lot line.
(6) 
The mobile home park lot line hereinabove referred to shall be the boundary line as established on the engineering plans.
(7) 
All mobile homes shall be located at least 25 feet from the mobile home park property lines.
Each mobile home owner shall be required to enclose the bottom portion of the mobile home with a metal, vinyl, painted pressure-treated wood or other water-resistant material, properly ventilated, within 60 days after arrival in the park. No skirt shall be required where a perimeter foundation (masonry eight inches in width) fully encloses the area between the mobile home and ground level.
The appropriate landscaping requirements for the mobile home park shall be determined by mutual agreement between the Town Planning Board and the applicant.
A. 
General requirements. A safe and convenient vehicular access shall be provided from abutting public streets or roads. The Planning Board may require additional entrances or exits whenever it deems it necessary for the public safety and welfare.
B. 
Access. The entrance and exit roads connecting the park streets with a public street or road shall have a minimum road pavement width of 20 feet and a total width of 36 feet, including rights-of-way. There shall be no obstructions on any entrance or exit road at the juncture of such road with a public road, and visual sight distance along the road shall be for a minimum distance of 100 feet in both directions or as required by the New York State Department of Transportation.
C. 
Internal streets. Surfaced roadways shall be of adequate width to accommodate anticipated traffic, including emergency vehicles, and in any case shall meet the following minimum requirements:
(1) 
Where parking is permitted on both sides, a minimum pavement width of 28 feet will be required.
(2) 
A minimum road pavement width of 22 feet will be required where parking is limited to one side.
(3) 
A minimum road pavement width of 18 feet will be required where off-street parking is provided. Each off-street parking space shall have an area at least nine feet wide and 20 feet long, not including maneuvering to access areas.
(4) 
The paved portions of such streets shall be finished with a smooth, hard and dust-free surface which shall be durable and well-drained under normal use and weather conditions.
(5) 
All streets shall be constructed, graded and leveled so as to permit the safe passage of emergency vehicles at a speed reasonable and prudent.
(6) 
A cul-de-sac shall be provided in lieu of closed end streets, a turnaround having an outside roadway diameter of at least 120 feet or an equivalent T-turnaround shall be provided pursuant to Town of Barton Highway Specifications.
D. 
Parking. Two off-road parking spaces must be provided for each mobile home lot, which shall be not less than 360 square feet in size.
E. 
Lighting. The appropriate lighting, including but not limited to spacing and type of lighting units, as will provide necessary illumination for the safety of pedestrians and vehicles, shall be determined by mutual agreement between the Town Board and the applicant.
A. 
Water. An adequate supply of water shall be provided for mobile homes, service buildings and other accessory buildings as designated by this chapter, which water supply system shall be approved by the Code Enforcement Officer or other authorities having jurisdiction thereof.
B. 
An adequate and approved system shall be provided in all parks for conveying and disposing of sewage from mobile homes, service buildings and other accessory facilities. Such systems must be designated, constructed and maintained in accordance with the New York State statutes, standards and regulations.
C. 
Sewage treatment and/or discharge. Where the sewer lines of the mobile home park are not connected to a public sewer, all proposed sewage disposal facilities shall be approved by the Code Enforcement Officer of the Town of Barton prior to construction.
D. 
Storm drainage pipes, ditches, etc., may be required by the Town Board.
E. 
Garbage and refuse. Each mobile home park shall provide sanitary equipment to prevent littering of the grounds and premises with rubbish, garbage and refuse, and all containers shall have tightly fitting covers. Regular disposal shall be provided for all rubbish, trash and garbage. All areas shall be kept free of abandoned or inoperable vehicles, trash and junk.
A. 
Every park shall contain an electrical wiring system consisting of wiring fixtures, equipment and appurtenances, which shall be installed and maintained in accordance with the local electric company's specifications and regulations and also in conformance with the National Electrical Code Standards.
B. 
All individual mobile homes installed in a mobile home park will be serviced electrically according to the National Electrical Code Standards.
A. 
Fuel oil supply systems.
(1) 
General requirements. All fuel oil supply systems provided for mobile homes, service buildings and other structures shall be installed and maintained in conformity with the New York State Fire Prevention and Building Code and generally accepted standards of NFPA.
(2) 
Specific requirements.
(a) 
All fuel oil tanks shall be placed not less than five feet from any exit.
(b) 
Supports or standards for fuel storage tanks are to be of noncombustible material.
B. 
Gas supply.
(1) 
Natural. Natural gas piping systems installed in mobile home parks shall be maintained in conformity with utility company practices.
(2) 
Liquefied gas.
(a) 
Such system shall be provided with safety devices to relieve excessive pressures and shall be arranged so that the discharge terminates at a safe location.
(b) 
Systems shall have at least one accessible means for shutting off gas. This means shall be located outside of individual mobile homes.
(c) 
All liquid propane gas piping shall be well-supported and protected against mechanical injury.
(d) 
Storage tanks shall not be fewer than 100 pounds and must be located not fewer than five feet from any exit.
A. 
Every mobile home park shall have a recreational area for the public use of persons living in the park. The minimum size of such area shall be 5,000 square feet, plus 200 square feet per mobile home furnished by the applicant.
B. 
The Planning Board, as a condition of approval, may establish such conditions on the use and maintenance of open spaces as it deems necessary to assure the preservation of such open spaces for their intended purposes.
A. 
Issuance; expiration. After such time that all rules, regulations, codes and provisions of this chapter have been met, the Town Clerk of the Town of Barton will issue a permit for operation and maintenance of a mobile home park. Said permit shall expire on December 31 of the year in which it is issued. Renewal of the permit shall be allowed for a twelve-month period.
B. 
Renewal of permit. Approval of the permit renewal shall be contingent upon demonstration that the design and maintenance of the park remains in accordance with the requirements at the time of approval of the initial permit.
C. 
Transfer of permit. All permits are transferable upon written notification to the Town Board.
