It shall be unlawful for any person or persons to conduct a garage sale in a single-family or multifamily dwelling of the Village of Blasdell without first obtaining a license and complying with the regulations as set forth in this chapter.

Garage sales in the Village of Blasdell shall be regulated in the following manner.

As used in this chapter, the following terms shall have the meanings indicated:

GARAGE SALE
Any public sale of personal property in any residence within the Village of Blasdell.

Garage sales shall not commence before 9:00 a.m. during the normal business week, including Saturday, and shall not commence before 12:00 noon on any Sunday, and must terminate by sundown on each given day.

A. 

No person or persons shall conduct more than one garage sale on his or their premises during any quarterly period in any given calendar year.

B. 

The duration of any garage sale cannot last longer than two full calendar days.

Garage sales shall offer only used items of personal property owned by the resident(s) of the property where the sale is held. No merchandise shall be offered for sale which is new merchandise transferred to the seller from other sources, other than through his (their) own purchase for private usage.

A. 

Garage sales may be advertised through the newspaper or other news media. A sign not greater than three by three (3 x 3) feet may be installed on any property where the sale is being conducted.

B. 

No sign shall be placed on the public right-of-way or on property other than where the sale is being conducted. No lighted sign shall be used.

C. 

The sign shall be displayed only during the sale and shall be promptly removed after the sale.

It is not the intention of this chapter to change or amend Chapter 267, Zoning, of this Code, nor shall zoning classifications have any bearing upon the effect or enforcement of this chapter.

A. 

It shall be unlawful for any person or persons to conduct any sale commonly known as a "garage sale" without first having received a license.

B. 

Upon application either in person, by mail or by telephone, the Village Administrator is authorized to issue such a license.

C. 

The license shall set forth the name and address of the person or persons conducting said garage sale and the date or dates of such sale.

D. 

The fee for said license shall be as set by the Board of Trustees.

Whoever shall violate or fail to comply with any of the provisions of this chapter shall be fined not more than $250 or imprisoned for not more than 15 days, or both, and each day that the violation continues shall constitute a separate offense and be punishable accordingly.
