Village of Blasdell, NY Chapter 145 LICENSED OCCUPATIONS

§ 145-1 License required.

No person shall carry on any of the trades, occupations or business hereinafter named or specified, or solicit orders, sell or attempt to sell within the Village of Blasdell without first procuring a license from the Mayor of the village or Village Clerk and paying the required fee.

§ 145-2 Production of license on demand.

Every person securing a license under the provisions of this ordinance shall produce the same upon the demand of the Police Administrator or other lawful authority of the village.

§ 145-3 Junk dealers.

A. All licenses to junk dealers shall be issued under the provisions of § 60 of the General Business Law of the State of New York and all such licenses shall expire on the thirtieth day of June next after issue as prescribed in said statute.

B. Junk dealers must pay a license fee as set forth by the Board of Trustees.

§ 145-4 Expiration of licenses.

All other licenses, except such short-time licenses as are hereinafter described and specified, shall expire on December 31 next after this issue. All short-time licenses shall state the term for which they are issued and the date of expiration.

§ 145-5 Revocation of license; transfer.

A. Revocation.

(1) The Mayor of the village may revoke any license granted by him or the Village Clerk if the holder of the license violates the state or federal law or any provisions of the Code of the Village of Blasdell.

(2) The word "revoked" must be written across the face of the license, dated and signed by the Mayor.

B. Any license issued by the Mayor or Village Clerk may be transferred, in writing, by either of them and not otherwise.

§ 145-6 Occupations requiring licenses.

Licenses may be issued for the carrying on, within the Village of Blasdell, of any of the following trades, occupations and businesses on payment of the fee stated after each, respectively.

§ 145-7 Auctioneers.

A. The license for the business of auctioneering shall be as set by the Board of Trustees (except that any person may sell at public auction his own property or premises owned or occupied by him or under or by virtue of legal proceedings or for a mortgage without a license).

B. Before securing an auctioneer's license, the applicant shall provide a bond in the sum of $1,000 by a duly authorized bonding company, conditioned for his faithful performance of his trust to all persons who shall consign goods for sale and to all persons who shall purchase goods at auctions conducted by him.

§ 145-8 Circuses and theatrical or public shows.

For circuses, theatrical or public shows of any kind the fees shall be as follows:

A. Every place entirely devoted to the purpose of a museum or theatrical representations, including theaters and opera houses: a license fee as set by the Board of Trustees.

B. For every circus or animal or athletic performance: as set by the Board of Trustees.

C. For a menagerie alone: as set by the Board of Trustees.

D. For every temporary exhibition of natural or artificial curiosities or other attractions: as set by the Board of Trustees.

E. For every theatrical representation, concert, lecture or public entertainment to which an admission fee is charged, not conducted by a local society and not otherwise provided for: as set by the Board of Trustees.

F. For shooting galleries: as set by the Board of Trustees.

G. For merry-go-rounds or like amusements: as set by the Board of Trustees.

§ 145-9 Concessions.

A license shall also be obtained from the Board of Trustees to conduct any public entertainment, show or any temporary business not included in the foregoing ordinances. A license shall not be required of any church or other organization within the village for holding any public entertainment within a building owned or occupied by such organization or other not-for-profit organizations within the village.

§ 145-10 Penalties for offenses.

Penalty of any violation of this chapter shall be punishable by a fine of not more than $250 or by imprisonment for a term of not more than 15 days, or by both such fine and imprisonment.
