The purpose of this article is to establish procedures for the use and
maintenance of holding tanks designed to receive and retain sewage, whether
from residential or commercial uses, and it is hereby declared that the enactment
of this article is necessary for the protection, benefit and preservation
of the health, safety and welfare of the inhabitants of Antrim Township.
Unless the context specifically and clearly indicates otherwise, the
meaning of terms used in this article shall be as follows:
HOLDING TANK
A watertight receptacle which receives and retains sewage and is
designed and constructed to facilitate ultimate disposal of the sewage at
another site. Holding tanks include but are not limited to the following:

RETENTION TANK — A holding tank where sewage is conveyed
to it by a water-carrying system.
C.
VAULT PIT PRIVY — A holding tank designed to receive
sewage where water under pressure is not available.
IMPROVED PROPERTY
Any property located within this Township upon which there is erected
a structure intended for continuous or periodic habitation, occupancy or use
by human beings or animals and from which structure sanitary sewage and/or
industrial wastes shall or may be discharged. The term "improved property"
shall not include or apply to barns or other farm outbuildings unless such
structures are improved with bathroom facilities for the discharge of sanitary
sewage.

OWNER
Any person vested with ownership, legal or equitable, sole or partial,
of any property located in the Township.
PERSON
Any individual, partnership, company, association, corporation, school
district, municipality, municipality authority or other group or entity.

SEWAGE
Any substance that contains any of the waste products or excrement
or other discharge from the bodies of human beings and any noxious or deleterious
substance being harmful or inimical to the public health, or to animal or
aquatic life or to the use of water for domestic water supply or for recreation.
SEWAGE ENFORCEMENT OFFICER
Such representative or agent of the Township appointed by the Supervisors
of Antrim Township, Franklin County, Pennsylvania.

TOWNSHIP
Antrim Township, Franklin County, Pennsylvania, a municipal subdivision
of the Commonwealth, acting by and through its Board of Supervisors or, in
appropriate cases, acting by and through its authorized representatives.

The Supervisors of Antrim Township are hereby authorized and empowered
to undertake within the Township the control and methods of holding tank sewage
disposal and the collection and transportation thereof.
The Supervisors of Antrim Township are hereby authorized and empowered
to adopt such rules and regulations concerning sewage which they may deem
necessary from time to time to effect the purpose herein.
The Supervisors shall have the right and power to fix, alter, charge
and collect rates, assessments and other charges in the area served by Township
facilities at reasonable and uniform rates as authorized by applicable law.
The collection and transportation of all sewage from any improved property
utilizing a holding tank shall be done only under the direction and control
and pursuant to regulations adopted by the Supervisors. No permit for the
construction, operation or maintenance of a holding tank shall be issued except
with the prior approval of the Board of Supervisors of Antrim Township.
The owner of an improved property that utilizes a holding tank shall:
A. Maintain the holding tank in conformance with this article
or any ordinance of Antrim Township, the provisions of any applicable law,
and the rules and regulations of the Supervisors and any administrative agency
of the Commonwealth of Pennsylvania.
B. Maintain a contract with a person approved by the Township
Supervisors to collect, transport and dispose of the contents of such holding
tank at the Antrim Township Sewage Treatment Plant at 13740 Worleytown Road
for as long as such holding tank is in use.
No permit for the construction, operation or maintenance of a holding
tank shall be issued except in those areas of the Township which are adjacent
to and not more than 150 feet from a proposed sewage line which is a main
transmission line and which has been approved by the Township and the Department
of Environmental Protection for construction and is shown on an official plan;
provided, however, that the Township Supervisors may authorize the issuance
of such a permit in other areas of the Township where the temporary or permanent
use of holding tanks shall be deemed by the Supervisors to be necessary and
proper.

This article shall be enforced by action brought before a District Justice
in the same manner provided for the enforcement of summary offenses under
the Pennsylvania Rules of Criminal Procedure. Any person who violates or permits
the violation of this article shall, upon conviction in a summary proceeding,
be punishable by a fine of not more than $1,000 or by imprisonment for a term
not exceeding 90 days. Each day or portion thereof that such violation continues,
or is permitted to continue, shall constitute a separate offense. Each section
of this article that is violated shall also constitute a separate offense.
In addition to any other remedies provided in this article, any violation
of §
110-31 above shall constitute a nuisance and may be abated
by the municipality or the Supervisors by either seeking appropriate equitable
or legal relief from a court of competent jurisdiction.
