There is hereby created the position of Parking Enforcement Officer. Notwithstanding any provision of the Uniform District Court Act and/or the Uniform Justice Court Act, the Parking Enforcement Officer shall have the power to issue and serve within the Village of Brewster appearance tickets and/or subpoenas for violation of the Vehicle and Traffic Code cases involving nonmoving violations. Such service shall have the same force and effect as if served by a peace officer without his or her being a peace officer.

A. 
To strengthen the authority of the Code Enforcement Bureau, and specifically parking enforcement, there is hereby specifically enacted to the Village Code the following sections of the New York State Vehicle and Traffic Law by reference:
(1) 
Sections 1100 to 1196, inclusive.
(2) 
Sections 1200 to 1253, excluding §§ 1204, 1223, 1229, 1229-a and 1229-b.
(3) 
There is hereby incorporated by reference all the sections of the New York State Vehicle and Traffic Law not previously incorporated into the Village Code, capable of being enforced by Village personnel, and not specifically excluded from being enacted into local municipal laws.
B. 
A violation of Subsection A(2) of this section shall be punishable by a minimum fine of $25.
Every person convicted of a traffic infraction for a violation of any provision of this chapter which is not a violation of any provision of the Vehicle and Traffic Law of the State of New York shall, for first conviction thereof, be punishable by a penalty of not more than $150 or by imprisonment for not more than 15 days, or by both such penalty and imprisonment; for a second such conviction within 18 months thereafter, such person shall be punished by a penalty of not more than $300 or by imprisonment for not more than 45 days, or by both such penalty and imprisonment; and upon a third or subsequent conviction within 18 months after the first conviction, such person shall be punished by a penalty of not more than $450 or by imprisonment for not more than 90 days, or by both such penalty and imprisonment.

A. 
Except those parts, if any, which are subject to approval under § 1684 of the Vehicle and Traffic Law of the State of New York, this chapter and any regulations adopted hereunder shall take effect as provided by law.
B. 
Any part or parts of this chapter and any regulations adopted hereunder which are subject to approval under § 1684 of the Vehicle and Traffic Law of the State of New York shall take effect from and after the day on which approval in writing is received from the New York State Department of Transportation.
