There is hereby created the position of Parking
Enforcement Officer. Notwithstanding any provision of the Uniform
District Court Act and/or the Uniform Justice Court Act, the Parking
Enforcement Officer shall have the power to issue and serve within
the Village of Brewster appearance tickets and/or subpoenas for violation
of the Vehicle and Traffic Code cases involving nonmoving violations.
Such service shall have the same force and effect as if served by
a peace officer without his or her being a peace officer.
Every person convicted of a traffic infraction
for a violation of any provision of this chapter which is not a violation
of any provision of the Vehicle and Traffic Law of the State of New
York shall, for first conviction thereof, be punishable by a penalty
of not more than $150 or by imprisonment for not more than 15 days,
or by both such penalty and imprisonment; for a second such conviction
within 18 months thereafter, such person shall be punished by a penalty
of not more than $300 or by imprisonment for not more than 45 days,
or by both such penalty and imprisonment; and upon a third or subsequent
conviction within 18 months after the first conviction, such person
shall be punished by a penalty of not more than $450 or by imprisonment
for not more than 90 days, or by both such penalty and imprisonment.
