There is hereby established a Planning Board
for the Village of Piermont, Rockland County, to be known as the "Piermont
Planning Board," consisting of five members appointed pursuant to
the requirements of § 7-718 of the Village Law.
B.
At the expiration of each original appointment, the
succeeding members shall be appointed for five-year terms.
C.
Any officials of the Village serving on such Board
shall not, by reason of membership thereon, forfeit their right to
exercise the powers, perform the duties or receive the compensation
of the municipal office held by them during such membership.
D.
Any member of the Board may be removed by the Mayor
for cause, after public hearing.

Alternate members.

The
Board of Trustees may, in its discretion, appoint two alternate members
to the Planning Board for terms of one year each. Alternate members
shall serve when there is a conflict of interest precluding participation
by a regular member, or when a regular member shall otherwise be unable
or unavailable to review, hear and determine an application.
(2)
The
Chairperson of the Planning Board may designate which alternate member,
in accord with this section, will substitute for a regular member
when such regular member is unable to participate because of a conflict
of interest on an application or any matter before the Board, or when
a regular member shall be unable or unavailable to review, hear and
determine an application. When so designated, the alternate member
shall possess all the powers and responsibilities of such regular
member of the Board. Such designation shall be entered into the minutes
of the initial Planning Board meeting at which the substitution is
made.

The
Chairperson of the Planning Board shall, at the first meeting of the
Planning Board in January of each calendar year, set a monthly schedule
establishing the order of alternate members who may hear and determine
an application under this section. Such schedule shall provide that
each alternate will fill vacancies on a rotating basis for each month
in the calendar year, and shall rotate which alternate member fills
the first vacancy in each successive month.

All
provisions of this section relating to Planning Board member training
and continuing education, attendance, conflict of interest, compensation,
eligibility, vacancy in office, removal and service on other boards
shall also apply to an alternate member.
A.
The Board of Trustees shall designate a member of
said Planning Board to act as Chairman thereof. Upon failure of the
Board to appoint such Chairman, the Planning Board shall elect a Chairman
from its own members.
B.
The Planning Board shall have the power and authority
to employ experts, clerks and a secretary and to pay for their services
and such other expenses as may be made for such Planning Board. The
Board of Trustees is hereby empowered and authorized to make such
appropriation as it may see fit for such expenses.
C.
The Planning Board may adopt rules and regulations
with respect to procedure before it and with respect to any subject
matter over which it has jurisdiction, after public hearing and approval
by the Board of Trustees.
A.
The Planning Board shall have all the powers and perform
all the duties of a Planning Board as provided in Article 7 of the
Village Law.
B.
In addition, the Board of Trustees hereby authorizes
and empowers the Planning Board to approve plats showing lots, blocks
or sites with or without streets or highways, to conditionally approve
preliminary plats and to approve the development of plats, entirely
or partially undeveloped and which have been filed in the office of
the County Clerk in which such plat is located prior to the appointment
of such Planning Board and the grant to it of the power to approve
plats. Before such approval is given, a public hearing shall be held
by the Planning Board.
The Planning Board of the Village of Piermont
is authorized, simultaneously with the approval of a plat or plats
pursuant to the Village Law, to modify applicable provisions of the
Zoning Ordinance[1] subject to the conditions of § 7-738 of the
Village Law and such other reasonable conditions as the Board of Trustees
may in its discretion add thereto. Such authorization shall extend
to any lands in the residential districts of the Village of Piermont.
The Village Clerk shall be directed to forthwith
file a certified copy of this chapter with the Clerk of Rockland County.
