No person shall hereafter erect, construct,
alter or repair that portion of a private driveway lying in or entering
on public roads of the Township of Pine except in accordance with
the terms and regulations of this article.
No person shall construct, alter or repair that
portion of a private driveway lying in or entering on public roads
of the Township of Pine unless and until he has secured a permit from
the Township of Pine, which shall be signed by the Zoning Officer.
The Zoning Officer shall issue a permit to any person of intended
compliance with this article and who, in addition, will fulfill the
following requirements:
A. He shall provide and submit to the Zoning Officer
a plan in writing showing the location, culvert size and finish grade
of said driveway.
B. He shall pay a permit fee as indicated in Chapter
A144, Fees, to the Township of Pine for the issuance of such a permit.
C. He shall show his intended compliance with written
instructions and requirements made by the Zoning Officer in addition
to the specifications and drawings provided by the applicant.
The Zoning Officer is hereby authorized to make
special requirements in writing on any applicant for a permit under
this article.
No permit shall be issued for the erection of
any driveway lying in or entering on a public road unless the elevation
of said private driveway lying in said public road is less than eight
inches above or below the grade of the public road at its highest
adjacent elevation.
All private driveways shall be so constructed
so as not to impede the flow of drainage water along the road. A standard
galvanized metal pipe or culvert or a reinforced concrete pipe as
required to pass the maximum drainage water under the private driveway
of not less than 15 inches diameter shall be installed under every
private driveway to a minimum length of 20 feet. Proper headwalls
shall be constructed on both ends of the culvert to retain driveway
fill over the culvert. A standard concrete trough covered by a proper
metal grating or a paved ditch may be substituted for the pipe culvert
in accordance with the Township standards.
Any person violating any provision of this article
shall, upon summary conviction thereof before any District Justice
in the Township of Pine or the County of Allegheny, generally be subject
to a fine of not more than $300 plus costs of prosecution for each
offense. Any road or driveway constructed in violation of this article
after the effective date hereof shall be closed until the provisions
of this article have been complied with.
Nothing in this article shall be construed to
create a liability on the part of the Township to any person erecting
a driveway in compliance with this article. The Township may remove,
change or destroy any private driveway or parts thereof lying in a
public road in the same manner and with no greater liability than
before this article was enacted.
